Regarding the denial of coverage for the microwave oven. I have reviewed the file and the following is a brief summary.
04/17/17 Plan...

07/24/17 Service request: microwave is emitting a burning smell and turns on by itself.
Dispatched: A and Z My Appliance
08/01/17 Status: the technician was unable to duplicate the smell or any malfunction of the microwave oven. He advised us that the microwave was functioning as designed. He also advised us that he diagnosed that the removable mesh filter screen located underneath the microwave was dirty and required cleaning. The technician removed the mesh filter screen and gave it to the tenant to clean. The tenant, Jennifer, agreed to re-install the mesh filter screen once it was cleaned.
Please refer to page 8 of the Plan that states:
“1. GENERAL LIMITATIONS. THIS PLAN DOES NOT COVER:
B. Routine maintenance or cleaning.”
08/04/17 Jennifer advised Old Republic Home Protection (ORHP) that she thought the microwave oven was making an unusual noise since A and Z My Appliance provided service. ORHP agreed to dispatch a different Service Provider.
Dispatched: California Appliance Repair
08/14/17 When California Appliance Repair arrived at the home for the appointment, the service was cancelled at the door.
02/19/18 Service request: the microwave oven will not turn on.
Dispatched: Xclusive Appliance Repair
02/21/18 Status: the technician diagnosed that the mesh filter screen was not installed which allowed cooking oil to accumulate on the working components. As a result, the oil damaged the diode, capacitor, blower, and other working components of the microwave oven. He advised us that this failure was not the result of normal wear and use.
Please refer to page 7 of the Plan that states:
“We will provide service for covered systems or appliances that malfunction, and are
reported, during the term of the Plan that:
C) Have become inoperable due to normal wear and use … “

In response to the reply sent by [redacted] at ORHP,
**. [redacted] indicates that he “reviewed the file about the service request for the refrigerator.” He states that after I spoke with Ms. [redacted] on March 30, 2018 I advised her that I would prefer to replace the refrigerator than to have it repaired. That is inaccurate. I had waited for 2 months by March 30 for ORHP to repair it but they just failed. I received four visits by their service providers and no one was able to repair it. Ms. [redacted] just told me that I either had a choice to keep waiting until ORHP found a vendor that had the parts needed or that I could just take $500 out of their kindness and use that towards the purchase of a new refrigerator. Ms. [redacted] expects my family to keep waiting and hoping for them to find a part as the months go by and my family keeps being forced to eat out as if we have the means to do so. That is like forcing me to keep wasting money as if that is part of the contract.
Since **. [redacted] is a professional in this business, I am sure he must be aware that refrigerators do not cost $500 in today’s economy. I am sure that by now and after reading my previous letters he must have an idea that I have spent probably three to four times that amount of money on food, eating out and items that have been and continue to be spoiled. This is going on almost three months. I will assume if **. [redacted] were in my shoes, he would feel upset about the way ORHP has been misleading a paying customer such as myself. He mentions that I should have received a check for $500 in 20 days, well since they record the conversations over the phone I am sure he can go back and hear that Ms. [redacted] said that I would be getting that check “expeditiously for all my troubles”. At this time, it has been over 20 days since that last conversation with Ms. [redacted] and close to three months since I started the service order and just like when I wrote to the Revdex.com nothing has changed.
Furthermore, he never mentions anything pertinent to the times I have reached out to ORHP in order for the company to have someone just fix the problem. His company has simply failed to do what’s right. Has he reviewed all the phone conversations I have had with different customer service representatives about the same issue? All those times that I have continuously repeated the same issues as to why I am calling.
He proceeds to direct me to call Ms. [redacted] again or her Supervisor **. [redacted] as if somehow after close to 3 months one of them will finally have the time to fix my refrigerator and or provide me with some real assistance to begin with. **. [redacted] perhaps didn’t fully read my letter to begin with – Here I will quote myself. “Ms. [redacted] should not be assigned to deal with complex issues as she has done everything she has been able to in order to delay any positive conclusion to this work order. I have several voice mails she has left me on which she constantly tells me different stories about what she has “found” out from Major Appliance Service, which in the end offer nothing new as this problem keeps going and I as the consumer continue to waste money as my refrigerator has not been fixed.”
The actions of ORHP are beyond unacceptable as the company is supposed to help the customers, the same ones that pay a premium for their services. ORHP is not doing me a favor, having a contract with them has proven to be costlier to me. I have had to spend so much out of pocket costs by now without any resolution to a problem they should have fixed within the first month. Their lack of professionalism from top to bottom is rampant.

Regarding the replacement of the water heater by an Out-Of-Network Contractor without our authorization and Ms. [redacted] request for additional reimbursement in the amount of $364. I have reviewed the file that indicates on February 28, 2018, my associate, Ms. [redacted], spoke with Ms. [redacted]. Ms. [redacted] requested a settlement in lieu of the replacement of the water heater by our Network Service Provider, A&P Electric. Ms. [redacted] advised her that our cost for A&P Electric to replace the water heater was $522 less the $75 Trade Call Fee (TCF). Ms. [redacted] advised that she would call back, if she agreed to the settlement.
On March 1, 2018, Ms. [redacted] spoke with my associate, Mr. [redacted], and advised him that she would accept $522 toward the replacement of her water heater. Mr. [redacted] advised her that the settlement would be $522 less the $75 TCF. On March 12, 2018, my associate Ms. [redacted], Call Center Supervisor, spoke with Ms. [redacted] and discussed that the reimbursement was based on our cost for the covered repair in accordance with the terms and conditions of the Plan less the TCF. I did confirm that the check for $447 was mailed to Ms. [redacted] on March 14, 2018.
Please refer to page 7 that states:
“We reserve the right to provide CASH IN LIEU of repair or replacement in the amount of
our actual cost. Payment will be provided based on our negotiated rates with our Service
Provider and/or Supplier network, which may be less than retail. We are not responsible
for work performed once you accept cash in lieu of service.”
After receiving the letter from the Revdex.com on March 13, 2018, and the Plan Holder requesting an additional $75 toward the replacement of her water heater, ORHP agreed as a gesture of goodwill to waive the $75 TCF. A refund check is being processed and Ms. [redacted] should receive the check within 20 days.
Please extend our apologies that the terms and conditions of the Plan do not provide additional coverage in this situation. While the intent of Old Republic Home Protection is to provide as much coverage as possible, the Plan is not all inclusive and there are limitations which are standard in the home warranty industry.

Regarding Old Republic Home Protection’s decision not to renew the Plan, and Ms. [redacted]...
dissatisfaction with our decision.
In reviewing the coverage we’ve offered over the last year, we have received $425 for the Plan fee, and paid out almost $1,000 in service cost, for a loss ratio in excess of 200%. For that reason, we have made the decision to not offer renewal.
We apologize for any inconvenience this may have caused Ms. [redacted].
In the event Ms. [redacted] wishes to maintain her home warranty coverage, she may wish to contact another Home Warranty Company to obtain coverage. We recommend visiting the National Home Service Contract Association website at [redacted] for a list of reputable companies. We do not suggest companies that sell home warranties strictly over the Internet, as many are not properly licensed and/or regulated as required.
While our goal as an organization is to serve others with a "People Helping People" philosophy, we hope Ms. [redacted] can understand our position, and am sincerely sorry that we cannot offer a renewal for this home going forward.

Complaint: [redacted]I am rejecting this response because:the amount that was provided for a water heater install is still insufficient even with the $75 trade call fee refunded. The standard reimbursement for a water heater (per OHRP) is $522. I was told I would receive a check for $447 as $75 was being deducted to pay A&P Electric for their time. This is in addition to the $75 trade call fee that I had already paid. However, as I stated in my original complaint, the total cost for the water heater replacement was $886. This is for an identical water heater to be installed, which is what OHRP advertised their plan would cover. This is the amount that should be reimbursed.Sincerely,[redacted]
Complaint: [redacted]I am rejecting this response because: The company is only in it for the money. They want you to pay for a warranty and drop you when you use the warranty. What is the point of having a warranty and when you use it they don't want to renew the plan for the following year. I guess they just want the money to come in and don't want any to go out.
In addition, when you contact them you have to deal with rude representatives. I am very happy with my new warranty company who actually offers more than this company. I am glad I kept looking!

Complaint: [redacted]I am rejecting this response because, this company hasn't fulfilled it's promises or their part of the contract since June 2017 for the repair of my refrigerator or pool. I don't care what Paragraph 9 says unless it is a full refund. This business doesn't return calls and until I contacted the Revdex.com and The Consumer Protection Board my calls and concerns went unanswered. They are rude, condescending, unprofessional and don't complete any job they are called to do. I had a pool issue as well that is still unresolved and unreputable repair people are the only ones sent and they want to come between 10PM-12AM. Thank youSincerely,[redacted]

With regard to Mr. [redacted]'s question; assuming the Out-Of-Network Contractor's (OONC) diagnosis differs from the Service Provider dispatched by Old Republic Home Protection, I may contact them to discuss their diagnosis to help determine coverage. If repairs have not been completed by the OONC, we may dispatch a third company to determine if they agree with the OONC or the network Service Provider's diagnosis. If repairs have been completed, then we will try to determine, absent a third opinion, which contractor was correct with their diagnosis after I speak with them. This obviously would be the most difficult situation to determine coverage, since there would be opposing opinions with the potential of no clear indication which contractor was correct.

With regard to **. [redacted] request to cancel his Plan; ORHP received his request on March 15, 2017, and our Accounting Department determined the service costs during the Plan term exceeded the unearned Plan fee. As a result, in accordance with the terms of cancellation, there was no Plan fee refund available. Please refer **. [redacted] to page 9 of the Plan that states:
“Cancellation: Florida Residents: If Plan is cancelled within the first 30 days of
coverage, you will receive a full refund. However, if services have been rendered, service
cost incurred, and a processing fee equal to 5% of the gross Plan fee will be deducted.
If Plan is cancelled by us, you will receive a pro rata refund for the unexpired term less
service cost incurred. Our reasons for cancellation include 1) nonpayment of fees; 2) fraud
or misrepresentation of facts material to the Plan; 3) upon mutual agreement between you

Complaint: [redacted]I am rejecting this response because:
I fully understand the policy that Old Republic's response has explained. It makes perfect sense that Old Republic's home warranty would not be responsible for items that were broken before the warranty took effect. My complaint is not about the existence of this reasonable policy, my complaint is that my fridge issue is, by Old Republic's own definition, not a pre-existing condition. I have an inspection report from my transaction to purchase the property showing that there was no issue with the fridge leaking/pooling water at that time. I looked at the fridge and found no issue during my multiple walkthroughs of the property as well. A few days after my closing, I began the process of moving into my new property. At this point, I noticed the water pooling in the bottom of the fridge, which has been an issue ever since. Since I have documentation that shows the issue began after I became the owner of the property (the Inspection Report), this should be covered by Old Republic's Home Warranty. If it is not covered, that is deceptive practice, misleading customers about what will actually be covered. I was told that because I noticed the problem the first time I opened the fridge as the owner (several days after closing on the property), Old Republic assumes the issue predates my warranty, even though I have proof that is not true. What if I didn't move in for several months and then noticed the problem, would that be covered? What if I didn't notice the issue and proceeded to move food into the fridge, and noticed the issue the next day, would I be covered then? Would having 1 bottle of milk in the fridge at the time I noticed the issue cause the issue to be covered? It seems I am being excluded from coverage solely because I did not put something into my fridge before calling, which would have had no effect on whether the fridge developed an issue.
For some context, Old Republic has a recording of my initial call to them during which I state that I noticed the issue right away upon moving in. All subsequent interactions with them have revolved around them referencing this recording and saying it is why they will never change their decision on this issue. They are missing the point and no one is actually listening to me, they are simply waiting to talk about the fact that they have a recording of me, and seem to take joy in the idea that I said something that they feel allowed them to deny coverage. Yes, I noticed the issue when I moved in. When I moved in was several days after closing. I have documentation there was no issue present during my purchase. Therefore the issue occurred during my ownership. The fridge was plugged in and running throughout this time period, which means it was "correctly installed and working properly on the effective date of the Plan, and (2) [has] become inoperable due to normal wear and use...after the date of coverage". If Old Republic does not cover this issue, I will have no choice but to take legal action.

the file that indicates the plumber diagnosed the cause of the water leak in the master bathroom was the result of an improperly installed water supply line. As for the leak outside the home, the Plan covers for water leaks located within the foundation of the home or garage.
Please refer to 7 of the Plan that states:
"We will provide service for covered systems or appliances which malfunction, and are reported,
during the term of the Plan that:
A) Are installed for diagnosis and located within the interior of the main foundation of
the home and garage (inside the load-bearing walls of the structure). Systems or
appliances located on the exterior or outside of the home (including porch, patio,
etc.) are not covered with the exception of covered items marked with a ,
B) Were correctly installed and working properly on the effective date of the Plan ... "
Please extend our sincere apology to Mr. [redacted] that the terms and conditions of the Plan did not provide coverage in this situation. I have no doubt that the fine print does not cover the items. The fact that this is called a "Home Warranty" yet covers so little is the real sham. The so-called "warranty" is a joke and they continue to feed off the people who pay for this thinking they are protected, when in reality in most cases they are not (again, as evidenced by the over 900 Revdex.com claims in the last 3 years). Businesses that scam the public do not last; hopefully this con-artist company will fade away soon.
