Above is the contract that Mr [redacted] has marked:...
PAID IN FULL.I also attach a copy of the letter I referred to on the telephone. In response to that letter, [redacted] called, was exceedingly rude, but agreed to come when: "In the neighborhood." He did call several weeks later saying he could come the following morning. I was several thousand miles away, the house was unoccupied and locked so I called and asked him to call another time (Voice mail message), He has never called since so I contacted Revdex.com after some months. I believe that he is not willing to drive the distance to my house for a small amount of work since he was already "Paid in full."There is absolutely no question that he accepted this molding as part of the job for which he was paid $500.00. He even asked me to obtain and stain the molding, which I have done. In his hands, this cannot represent more than 30 minutes work: 8 mitered cuts and tack it up. Less that 5 feet total 2" material!
Review: In March 2014 Mr [redacted] installed an exhaust fan in my kitchen as a replacement for the defective fan which he removed as part of this job. The removed SS duct had a wood molding which covered the gap between the duct and the ceiling. This was removed but did not fit the outline of the new duct. Mr. [redacted] agreed to install a new wood molding but asked that I supply a stained length of molding. He agreed to come back to take care of this.Because Mr [redacted] had earlier installed the entire kitchen remodeling including the exhaust fan, I trusted that he would honor his commitment and paid him in full, $500.00 on March 23, 2014. I have his original proposal dated Feb 14, 2014 signed as "Paid in full" on March 27, 2014. This, in spite of a provision in his proposal/contract allowing the withholding of $300.00 for incomplete or backordered work to be done. I paid in full as a sign of trust and respect for Mr. [redacted].After accommodating [redacted] by obtaining, finishing and staining a six foot length of molding, I notified him and asked that he return to complete the work. After 30 days or so, I called again---and again, and again, and again---leaving a message each time. He never returned a call or responded in any way. Finally, on one occasion months later, Mrs [redacted] answered the phone and assured us that he would get back to us in the next week. This never happened. After several more unanswered calls, I wrote a formal letter of complaint, dated October 1, 2014, asking that per his contract he refund the $300.00 pending completion by a third party. I agreed to remit the balance after I paid someone else to finish his job--a very small amount of work. This resulted in a prompt telephone response in which Mr. [redacted], amid ample abusive language, some in the four letter vernacular, complained that my letter somehow was "Abusive" to him--even after I patiently waited six months, unsuccessfully, trying to get him to complete the work for which he had been paid to do.Desired Settlement: Mr. [redacted] agreed to come and complete the work when he was "In the neighborhood." He did call once, weeks later while I was out of town, overseas, actually, left a message that he could come: "Tomorrow." I only received that message days later. I informed him, again via voice mail, that I was away. I have not heard since from Mr. [redacted]: another 9 months.[redacted] MUST FINISH THE JOB NOW!! I have asked another to look at it; will owe at least for time spent measuring.
