On or about October 10, 2019, I received an unsolicited letter from Forty Insurance agency claiming they could lower my homeowner's insurance. A few days latter, I contacted the agency and spoke with Mr. Forty. He asked me several questions about my property and asked whether I had an updated wind mitigation inspection (within the last 5 years), he explained this was necessary for new insurance policy. He recommended a local South Florida inspection company. Mr. Forty informed me that the lower insurance rates was with Avatar Property and Casualty Company.
Hesitant to change my insurance I contacted my current agent who told me that Avatar was not accepting new business in my area (Broward County). I called Mr. Forty and he reassured me that Avatar was indeed offering new policies in Broward. So trusting Mr. Forty, I made an appointment with South Florida inspection and paid $100.00 for the wind mitigation on 11/08/19. The inspection report was subsequently sent to Mr. Forty's agency. After several communications over the past 10 days with Mr. Forty, he informed me today that Avatar is not offering new policies in Broward County and that he could not offer a competitive lower rate on my homeowner's insurance.
I feel Mr. Forty was not forthcoming and truthful with the information. I feel he mislead me and I would like other consumers to be cautious of this agency.

Refund I am requesting a refund of $100.00 I paid (unnecessarily) for a wind mitigation inspection that I did not need in order to renew my existing policy. I feel Mr. Forty used deceitful and misleading advertising technique.
After fully reviewing your file, the timeline transpired as follows; Forty Insurance sent out the quote in early October. After initial conversations about your specifc risk, the updated quote was emailed on 10/28/2019. Avatar (and all admitted carriers in the state of Florida) requires a wind mitigation inspection with color pictures done within the past five years. Since you could not provide one, we asked that you get a new inspection from SoFlo Home Inspections. We have no affiliation with this company.
We received a copy of the wind mitiation inspection on 11/13/2019. When we went to finalize the quote from Avatar, their system blocked the quote due to capacity in that area. Every carrier in Florida practices risk exposure management and can close a given zip code at any time without warning. This happened in your area between the time we mailed you a quote and you had obtain all the documentation required to bind (wind mitigaiton inspection). The inspection you obtained is yours and is good for five years. Every insured that calls us is required to either provide a copy of this inspection or we request that they get one from a long list of companies we recommend based on the area your home is located. I'm sorry we couldn't do more to help but when our quotes go out, they are approved by our carriers. Sometimes, when the insured calls us and we go through claims history, age of updates, etc, the risk isn't approved. Again, I apologize and thank you for the opportunity to work with you.

Mr. Forty clearly failed to provide correct information. I have text messages from Mr. Forty dated 11/04 at 0820 reassuring that Avatar was underwriting new policies in my zip code***. This was after I expressed my concern. Mr. Forty instructed me to obtain wind mitigation inspection which I did. I feel he used deceptive advertising technique to solicit business; moreover, he clearly encouraged me to use SoFlo Inspection Company. I paid $100.00 unnecessarily, for wind inspection. I did not need wind inspection to renew my existing policy. These are the facts. Thank you.
I will reiterate the timeline. We sent out an approved quote early October. On 10/28 insured inquired about the quote in question. We cannot move forward without a current wind mitigation inspection (dated within the past five years). Since this wasn't provided, a current copy of an inspection was requested from a suggested inspection company. We received and provided this to insured when this inspection company finished. When binding was requested, Avatar had closed the zip code for new business. This happens often that is why our quotes are not guaranteed (we say this on the letter). We do not control when carriers open or close zip codes but we do require a 5 year old or newer wind mitigation for every home unless it is new construction. I'm sorry the timing didn't work out but we have the same procedures for all the agencies we have provided quotes for since 2005. Every insured (client or not) needs to provide a five year old or newer wind mitigation inspection and we have no affiliation with any inspection company. We have hundreds of companies we work with in the state of Florida and we select ones close to your property.
