Initial Business Response / [redacted] (1000, 5, 2015/09/14) */ Dear Berenice: I am the manager at Fort Washington II and responding to the above referenced case per her complaint First let me say that [redacted] has not moved out yet, and has requested a pre-inspection in which we will call and schedule approximately a week before her move-out date of 9/30/Until we inspect the unit there is no way that we even know what the condition of the carpet isEven with a pre-inspection if there is furniture in the unit we will not be able to determine the condition of the carpet until we do a final move-out inspection My assistant [redacted] spoke with [redacted] on 9/1/15, and then I followed up with a phone call on 9/3/We both explained to her that if she wanted she could provide a receipt showing that she had the carpets professionally steam cleaned The laws that she is quoting is from the Ca.gov Consumer Affairs regarding use of Security DepositsThis has not been updated since 2012, but this is what it states: California law specifically allows the landlord to use a tenant's security deposit for four purposes: For unpaid rent; For cleaning the rental unit when the tenant moves out, but only to make the unit as clean as it was when the tenant first moved in;For repair of damages, other than wear and tear, caused by the tenant or the tenant's guests; [redacted] signed a lease, and the moinspection report stating that she would leave the unit in the same condition as she received it (as the law states)This unit had new carpet when she moved in, but there again we have no idea what condition of the carpet is If she had questions when she signed the lease or the moinspection she should have asked at that time If you have any questions, please do not hesitate to give me a call Sincerely, [redacted]

approximately a week before her move-out date of 9/30/15. Until we inspect the unit there is no way that we even know what the condition of the carpet is. Even with a pre-inspection if there is furniture in the unit we will not be able to determine the condition of the carpet until we do a final move-out inspection.
