I inquired with ***, the owner of the company, about designing a logo for me. Her response timing was dragged out, but I asked her to send me a portfolio of her work, which she sent me a few pictures of past work. It was okay work, so I decided to go with her, especially because I wanted to support a local business. We never agreed on a price, she just asked me my budget, I told her, and that was that. She never specified the deposit amount and I had no idea what to expect, so I offered a $25 deposit, which she agreed to and began working on the logo. She informed me that she would send me "multiple sketches," which she only sent me one, and I had to ask her to send me another to have something to compare. She sent me two sketches. I didn't like them fully and I critique her work, being that I was paying for the work, and after asking her to revise it twice, she became defensive and stated that drawings under $300 only get 3 revisions, which my budget was $150. She was tired of revising the work and wanted me to settle, but I didn't like it fully to accept it. I told her she could've told me that upfront; she then said I could've done my due diligence as a customer and researched her before agreeing to her working with me. However, when I asked for her portfolio, she did not include her business page, that supposedly discloses all her information. She became argumentative with me. So I decided to not finish with her, I fired her, and made a review on my personal *** page, in which she got upset and got on her *** and defamed me, slandered my name, and called me all types of foul words when she went Live in video. She enticed her friends to begin harassing me through social media, and she was all around unprofessional. I not once attacked her character personally, just her work ethic, in which she provided sub par professionalism and was just nasty and rude as a business owner.
Revdex.com spoke to the business and the following was relayed: This was done as a favor outside the shop. It has nothing to do with the business.
Below I attached photos of my personal *** account(***) and business account(***) , both accounts have a photo of my shop, as I’m a proud business owner, and it’s my first business so it was uploaded to majority of my social media and email accounts. My shop only uses the *** account, *** is my personal account and is used for transactions outside of the shop. Below I also attached a clip that shows the transaction made by the client to my personal account, *** Business was done via messages on Facebook, and the design process started on my tablet, from the bed of my home. I never discussed or set foot in my shop to do business with the client, or to even create the design, everything was done from home, as my shop is closed temporarily due to the covid19 pandemic. Also, I have not billed the client since shes made her deposit. The transaction and process was never completed due to her firing me and cancelling my services, even after I insisted on finishing the sketches for her, to move along to the next step in the design process. She never paid the $50 deposit required to get started, in fact she only made a partial payment of $25, therefore she didn’t receive any physical copies of the sketches I created. I will remove anything I posted awhile ago regarding this matter on my personal *** account if she removes her posts too and discontinue the consistent false accusations and slander online about me and my business.
I have reviewed the response made by the business in reference to complaint ID, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.
In response to *** comment; most parts are inaccurate. I made 1 post (review) in reference to the quality of her service, which will not be removed because she doesn't like it. That is equivalent to *** gas station asking a consumer to remove a remark about the experience they had with the company; that just will not fly. Other than that, no other posts have ever existed and still do not.
I am well within my 1st Amendment right to disclose my opinion on her business. However, *** calling me a "***" personally due to the fact that she didn't like my review is not. I've attached all correspondences with ***, including the video of her calling me out of my name, using "fighting words," which were established through the Fighting Words Doctrine in Chaplinsky v New Hampshire, 315 U.S. 568 (1942). As well as the back and forth, showing, I did none of what she claims (slander, etc.) She, on the other hand, unprofessionalism is so pervasive, she's even gone as far to say on social media that she would come for my business if I had filed a claim against her, as she attempted to coax people into not supporting me. Additionally in the correspondence, you will see where I asked her how much to give as a deposit, which she never stated she required a $50 deposit. I asked her from the beginning of my inquiry what were her stipulations. She didn't even tell me she required deposits until I asked how I go about solidifying this task for me. She wasn't clear on anything, not even a price. She asked what my budget was after I asked how much is her service and she never disclosed. I assumed she was "maxing out" my budget, which could be read in our correspondences. I do not agree with her recommendation and I would like her posts removed and my refund. Side-note, I couldn't figure out how to attach the video of *** slandering me, so here is the link to the video that I uploaded myself to make it accessible solely for these matters. *** Regards
