Review: I started a one month trial period to a fitness trainer in June/July 2011. I paid for the first month via check. I started a plan in August 2011 and paid August 2011 via check. I had approx. 2 weeks of training between August and September 2011. I told the trainer that I was unable to continue after the first week of September 2011 because I was starting grad school. He ach'ed September 2011 monthly payment from my checking account. He took $375 from my account when he was authorized to take $349. I cancelled the ach from my account. He has sent my account to collections. I did not pay. The collections service has now attached my credit report and has a balance of $1440. I would like to file charges against [redacted] for theft and violation of contract.Desired Settlement: I would be willing to settle to allow him to keep the $26 and not file charges of theft against him if he will stop the collections service.
