Late fees assessed that are not specified in the contract
On January 31, 2019 I signed a contract with Fit 4 Life in Cameron NC. The contract is VERY SPECIFIC in terms of the fees required. Including the 2 months worth of fees required to cancel this membership. NOWHERE in the contract are late fees mentioned, implied or otherwise. There are also no mention of fees assessed for returned payments etc. In July 2019 I went into the gym, in person and requested to cancel my membership. At that time I was made to pay the $49 fee for Facility Improvements (mentioned in the contract) and then an additional $20 in late fees in the gym itself, not through the billing company. I asked where the late fees were stipulated in the contract and were told the fee is charged by the billing company and not the gym itself. I have since been in contact with the billing company and verified that this IS NOT the case. The notice from the billing company even states the $20 fee is "Club Service Fee". I have emailed Fit 4 Life and received no response. I called and left messages for managers who never returned my phone calls. Today, August 30,2019 I called and asked for a manager and I was told that I was speaking to one. He would not give me his name but proceeded to yell at me and tell me they do not have to out late fees in their contract and can charge whatever they want. If they are not bound by the fees in THEIR own contract then why should anyone else be? I have examined my records and I have been charged a total of $120 in late fees. These fees occurred in, March 2019, April 2019, May 2019, June, 2019, July 2019 (Facility Improvement) and I am being charged the fee again on this month's bill. That is a total of $120 in fees that are not lawful based on the contract THEY drew up for members to sign. I have asked for a refund and been flat out refused. I would like them to be made to answer for these unlawful charges. I had originally asked to have the late fees applied to the $79.98 in outstanding charges for the fees to cancel my account and I would not pursue the remaining $40.02 but since they are not willing to negotiate, I would like a refund for the entire $120.

Fit4Life Did not uphold the contract to be open 24/7.

In May 2019 I went to the fitness center and the key tag access was not operable. There were no employees available to answer the door and no patrons inside. There were about 8 patrons waiting outside. There was no phone number available to contact in case of emergency. I called the fitness center number at *** and was answered by voicemail. The only alternative was to contact the fitness center on ***. I left a message that the gym key tag reader was broken. I asked that they provide an emergency number so that we could contact someone if access was a problem. I received a message 2 weeks later of ***

Hi ***. We just wanted to apologize again for the inconvenience of the key scanner not working. We would like to offer you a free training session with one of our personal trainers. What is a good time of day for you? I don't need a personal trainer, I need access to the gym as promised in our contract. I only as

On June 11, 2019 there was a note posted that the gym was going to be closed from 12-14 June for remodeling/upgrading. I didn't go to the gym those days. When I arrived on June 15, the gym had another sign posted indicating that they were going to be closed until June 18.

Here is an example of my concern:
You prepay for grocery order at the store and drive pick them up. You get there and they tell you that you cannot have the groceries now, you have to wait three days. You don't get a refund. You never received notification that the order is not available. You drive back to grocery store three days later. You are notified by a sign on the door that you cannot have your groceries and you have to wait another 4 days. No one notified you, they have your money and there is no consequence for the lack of service.

This is the only gym in the area. I could have driven to the Fit4Life in Fayetteville (35 miles) and used that facility (1hr 10min round trip). The consequence of complaining about the unethical business practices of Fit4Life is that they are the only gym in the area and will recommend cancelling our membership. They will indicate that they are upgrading our fitness center. Upgrading is great but I didn't ask for an upgrade, I contracted for the 24/7 access. Fit4Life didn't uphold the contract.

Desired Outcome

Resolution: The Fit4Life fitness club should refund me for the dates that they were not open. They broke our contract for 24/7 access

During this time, the gym was undergoing renovations. The projected date was 3 days from when we closed, but unfortunately we had some hiccups and had to close longer than what was projected. As soon as we knew we would we closed we immediately posted signs as well as on social media about the delay in the renovations. During this time, members had access to three other locations- two locations in Fayetteville, and one location in Spring Lake (just 7 minutes from our location). We did everything we could to notify members and provide them with the service. This member has not come to management with any concerns or complaints to allow us to rectify the situation. We will be contacting her and giving her a free month at the end of her membership, but we were unaware of the situation.

Fit for Life response: As soon as we knew we would we closed we immediately posted signs as well as on social media about the delay in the renovations.
My response: They did post signs, but I had to drive to the gym and was notified by signs posted. I don't look at social media to determine if an organization will be closed.

#2 response: Hey! I'm sorry for the inconvenience. *** has the updated date and time posted. Unfortunately, the dates and times of the construction is out of our hands. The construction team needed more time to make our location the best it can. Tuesday at 9am we will be back open and all of our members will be extremely happy. Until that date you will and have had access to all other locations. Including the Anderson creek location. 5 miles away from our location. Thank you for reaching out. If you have any further questions or concerns please let me know. Thank you!

My response: It would be helpful if you notify us via email or text. It's annoying to have to drive all the way to the fitness center and find out it's closed.
Fit for Life response. Thanks for messaging us. We try to be as responsive as possible. We'll get back to you soon. The gyms been open since Tuesday.

The bottom line: I paid for fitness center access 24/7. I was not able to use the fitness center for 1 week. I have not been contacted.

I had to pay 2 extra months for canceling my contract due to relocation orders. They never disclosed I had to pay with orders after a year contract
I signed a year contract with them in April of 2018. I was told in the beginning if I brought in relocation orders it would terminate my contract. So in February 2019 I brought in my orders of relocation and they said I can't cancel until April. Which is a violation of contract. I went back in April to cancel with my orders and they made me sign this "mini contract" saying in order to cancel it would take 2 months and I'd pay for those months. I feel like that's a breach in contract. I had reoccurring payments from my debit card from ***. I feel like I'm the least I should be refunded for the 2 months extra I had to pay which was not disclosed even with relocation orders. How do I use a gym when I move? It made no sense

I'd like at least a refund for the 2 months extra I had to pay. Also, I'd like them to shred my card info because I do not what to be charged anymore

On the membership contract there is a portion that describes the cancellation policy. All cancellations require a 60 day notice. That portion of the membership requires a separate signature which is signed on ***'s contract.

When I signed up at fit for life I was told by the manager *** that if I needed to move on short notice the 60 day notice did not apply. He stated very clearly and specifically the 60 day rule was waived both in regards to the 12 month contract and the 60 days notice as long as we give notice as soon as I know. We had a specific conversation because my job often requires me to move on 2 to 3 weeks notice. The manager *** refuse to allow me to talk to the owner *** or leave a message for him stating that *** he would tell me the same thing and she knew what he was going to say so there was no reason for me to talk to him . *** Is aware that the manager *** who signed me up set a lot of misrepresenting and misleading things to his clients and in fact he opened another gym and tried to solicit all of for for life's clients a couple weeks after I joined. *** previously corrected and if she were I was being charged $20 too much for several months-after the front desk staff refuse to do so After he learned *** signed me up because he is well aware that *** did many unethical things. I believe *** would have honored what his manager stated. I would like to also know that *** said it is true you can terminate prior to 12 months if there is a move, though that is not stated in the contract either. Yet she would not honor or even allow me to speak to you or leave a message for the owner regarding my concern. I believe my membership should be canceled March 1 when I am moving. I notified fit for life via phone at the end of January, I spoke to ***, telling her that I had to move and I wanted to let them know but I am out of town for three weeks working so I'm calling to give my notice. She said no problem just to come in and fill out a form when I get back. I believe my membership should be canceled March 1 when I am moving. Billing Adjustment I would like for my cancellation to be effective March 1 the date of my move. As the manager stated it would be when I signed up. I do not want to be billed for March or April. I was already over billed $20 for several months that was never returned to me do you to staff error that originated because of the same manager

Member signed a 12 month agreement on 11/2/2017 it states the following
" At the end of your agreement, contract will continue on a monthly basis until notification in writing or a cancellation form is filled out. MUST give 60 days notice upon cancellation.

We did not receive any written form of cancellation until 18/2/2019 which means as per the conditions of the agreement she must pay for March and April and the membership will then cease as of 30/4/2019.
If you require copied of these documents I can provide these.

It is correct the contract states this. However the manager *** verbally stated to me and others that it was just a form and that it did not apply in situations like mine. This manager troy also made many other false representations that the owner *** has previously acknowledged and made right because he knows that *** did this intentionally as a representative aloof fit for life because he was leaving to start his own gym.

Furthermore- their staff told me on the phone at the end of January that they could not accept fax (I was out of town for work) but they would make a note and when I came in to sign 'their' form they would honor the date I called since their policy was 'prehistoric' ((their word not mine). I do not think it is right, fair, or legal for them to fall back on a form when employees acting on authority of fit for life or making statements both when I signed up and as recently as the end of the month ensuring me that I will not be charged for certain things-then when the situation actually occurs they act like we can only go by the form. I have moved from NC, and the business will not break my contract even though they state if you move your contract can be terminated.
I called Fit4life Friday November 10,2017 and spoke with the manager and explained to him I moved, and no longer can utilize the service of the gym. Instead of him asking details surrounding my move he asked me do I have a lease or utility bill, I said no, he then said my contract was still an obligation. I asked him could I provide a letter from my job stating that I've moved he said no. That I had to have a lease or utility bill. I clearly no longer live in NC if I am working in VA, because of how quick I moved. I cannot provide a utility bill or lease because I am currently staying with family until February when I plan on moving into my own apartment. I forgot his name but he was rude and not helpful when I asked to speak with the owner he stated he was the only person that could help me and wouldn't give me the information. I am no longer living in NC I think the owner would allow me to break my contract if I provide them with proof of that. I am not waiting until Feb 4 months from not to have my contract terminated when it clearly states if you move your contract is terminated. I will not pay this business anymore for the use of a gym I have no access to. I would like to speak to the actual owner to have my contract terminated by providing them proof outside of a lease or utility bill.

We are just receiving this complaint in our business mail box at the*** Club due to being locked out of the mailbox for missing key so I apologize for the delayed response. We would be happy to accept the following 2 items to terminate Ms. agreement. A letter from her current employer AND a cell phone bill going to Ms. new address in Va. where she is residing now. Once we receive these 2 items we would be willing to back date her 60 day cancel request to the date she said she called in and spoke to someone on November 10th. That would put her actual cancel date as January 10th, 2018. Ms. has not paid her December or January dues so those 2 months would need to be collected as well and her account would be able to be cancelled due to move. We are willing to waive the late fee's for both these months as well bringing her total owed $99.98 down to $59.98.

First and foremost thank you for responding and being willing to resolve the matter. Secondly I am not advised to pay anything when I moved November 1st and still paid Novembers month membership. The late fees, and monthly membership fee from December and January are no longer my responsibility being that I called and tried to dispute this issue early November as you and I both stated. I have no issue providing you with two things. A letter from my supervisor, and my cash app and venmo statements stating I paid rent for a room I am currently living in***, VA. Also the only time a 60 day cancelation policy is in effect is when you are canceling your contract willingly not because of immediate relocation. I called and tried to resolve this issue but there is absolutely no reason on why I should be paying anything, are you making soldiers pay a cancelation fee, when they receive orders? I am no longer and have not lived in NC since the end of October, and I started my job November 1st that is where money you receive from me ends.Contract wise I am not obligated to pay anything from the start of my relocation.

When I signed a contract in March 2016 with Fit4Life in *** NC it was not explained to me that in order to end my 12 mth contract I had to give a 60 day notice prior to the end of my 12 month contract. I understood at the end of my 12 month contract that it would just end if I did not sign a new contract with them. My contract ended in April 2017. A friend told me about the 60 date notice so I went into Fit4Life and explained to them how I thought the contract just ended after 12 months. I explained to them that I was not told about the 60 day notice. After going back amp worth with the manger she waved 30 days from my 60 day notice. I did not agree with only 30 days but I was not getting anywhere with her. So I accepted that. I signed a termination notice that day April and paid my May membership fees. Then in June 2017 I was charged again I went into the office and talked with the manager. She agreed that I should not have been charged for June. My notice was signed

The *** office properly cancelled *** out with a 60 day notice as is required and is stated on the signed membership agreement. The membership agreement states "AT END OF AGREEMENT CONTRACT WILL CONTINUE ON A MONTHLY BASIS UNTIL NOTIFICATION IN WRITING OR CANCELLATION FORM IS FILLED OUT. MUST GIVE 60 DAYS NOTICE UPON CANCELLATION." The cancellation form was filled out April 10th 2017. 60 days from April 10th would be June 10th 2017. The last bill date was June 5th 2017. *** will no longer be billed. Fit4Life of *** has all supporting documents including the following; signed membership agreement, signed cancellation policy, signatures to authorized card use to draft from her specific bank account. You can find our cancellation policy at the bottom. The $24.99 will not be refunded.

Per *** - the Manager, my 60 day cancellation was waived & only a 30 day notice was required. My last payment was in May 2017. *** told me this on April 10, 2017 when cancellation forms were signed. *** told me the same thing in June 2017. When I questioned her about the June payment, with a witness of Fit4Life present, *** stated - "You should not have been charged for June. Your 30 day notice ended May 31, 2017. I am not sure why your card was even charged. We are not able to put the funds back on your credit card. A refund check will be mailed to you today."

A week later, I went back - Per *** - "Your refund check was lost. We have issued you another refund check. You should have the check in 5 days."

Another week later - I called and left a message for ***. Letting her know that I have not received my refund check. I have not had any response yet.
