I bought my house April ( [redacted] ***) and I was told that I was part of [redacted] HOA Monies were deducted on my closing cost documents and I was billed for quarterly dues which I paid I tried to get first residential to mow the empty lots on my street and they told me that the street I live on is "NOT PART " [redacted] HOA and was never annexed to be part of the HOA This was verified by an email they sent me stating that since my street was not part of the [redacted] HOA, they would be refunding my moniesI have tried calling their office on numerous occasions but to no avail

Sir/Ma'am, As previously stated, we had to receive approval from the board to refund the funds, because they are in the HOA's bank account, even if they were collected by mistake at closing The board approved the refunds last week Mr [redacted] was sent a refund last week in the amount of $600.00, which included $as Working Capital collected at closing and $of paid assessments After reviewing additional information with the board, we issued another check to Mr [redacted] in the amount of $bringing his total refund to $ We explained to him that he would have to contact RealManage for the $he paid in transfer and processing fees, since those monies are paid directly to the management company, which was RealManage at the time Regards,FirstService Residential
I live in California and purchased a home in San Antonio TX in 4/The home has a Homeowner's associationI never received a bill from them for the quarterly assessmentsIn 6/2016, I received a letter from an attorney stating I owed $in assessments and late fees plus over $in attorney feesI contacted the attorney's office to find out why the HOA never billed me, they gave me the contact information for the HOA and I calledApparently, they did not have my mailing address, I gave it to them and asked that new bills be sent thereI called the manager and left a voicemail asking for assistance since I did not know what services they provide, where to make payment, etcShe emailed me and referred me to the attorney's office; she refused to call me backIn 9/I received letters threatening foreclosure from the attorneyAgain, I called the HOA to no availI paid the attorney a total of $On 11/8/16, the attorney sent me another letter saying I still owed $

For the last statement period at the end of last
year, I was enrolled in paperless statement without my knowledge and consentThus, late fee of $was incurred as paper statement was never receivedAfter contacting with FirstService Residential, I was promised a $credit for the next statement in June However, no credit appeared and I have tried to email FirstService Residential several times, all without any response or attempt to remedy the issueI am very disappointed in the absolute lack of communication and transparency of FirstService to its customers
Response to desired settlement:
The request to have the $late fee waived has been denied by the Trails of Fairfield Board of DirectorsTheir decision was based on the fact that the owner knew that the assessment was due even though they did not receive a paper statement

I am a resident of the Mesa Oaks Subdivision in *** *** The Mesa Oaks Subdivision HOA is managed by FirstService Residential Along with all other HOA members, I pay a $annual management fee to FirstService Residential
On September 2018, I contacted *** ***, the Association Manager at FirstService Residential who is responsible for maintenance of the Mesa Oaks Subdivision, regarding damages to the entrance of the subdivision I requested *** *** to contact me by email I received NO response I followed up with an email to *** *** on September Again, I stated that I preferred to be contacted by email As of October 2018, I have NOT received a response from FirstService Residential
FirstService Residential carries out the directions/decisions of the Board of Directors of the Association. *** *** West and East, while appearing to be two separate neighborhoods, are actually all within the same homeowners association and community, *** ***. The
community / Association are now in Developer Control, with members of the Association Board of Directors being appointed by the Developer / Declarant. The Board has authorized closure of the gates from 8PM to 6AM Monday through Friday and 6PM to 6AM Saturday and Sunday. The Board has reviewed the recent homeowner requests for 24/closure and has instructed management to follow the closure policy already in place. Sales personnel at the various builders within the community do not take direction from the HOA Board and / or FirstService Residential, meaning that what potential owners are told by sales teams is not in our jurisdiction / control. There is no ‘profit’ in the HOA and is actually funded by Developer loans while the community is in the development stages. Owners can request a copy of the Association financials by contacting their assigned Manager at FirstService Residential
