In response to the above complaint, we have enclosed correspondence sent to the complainant on July 16th, 17th, and 29th regarding his complaintFurther, we have talked with him over the phone on several occasions during the same time periodWe have not avoided the complainant, but instead made
every effort to be clear and transparent as to the fees paid from his accountAt no time were there any fees applied to his account that weren't previously explained and agreed to by plan representatives authorized by the employer (*** *** *** Group) to act on behalf of the planContrary to complainant assertions, loan maintenance fees have always been applied each year, for the last four yearsThere was never a change to this policy, as he suggestedFurthermore, all loans were processed electronically and original signed paperwork (should any exist) would have been retained by the employer (not Burke Group)It is the employer, not Burke Group, who handles employee payroll,and makes changes to this payroll to start paycheck deductions for loan repaymentsFinally, Burke Group does not sell any financial products, such as Individual Retirement Accounts (IRA), as asserted by the complainantNever have we suggested to anyone that they "move their money to an IRA with Burke Group"We simply process the distribution based solely on the employee's directionBurke Group has served retirement plan participants for over yearsWe pride ourselves on providing exceptional service at a reasonable priceWe have delivered on that promise to our customers and their employeesIn this instance, we did nothing to deserve the misrepresentations alleged in the complaint, and we do not believe the complainant was treated unfairly by our firmSincerely, Richard Burke Burke Group See attached documents
