rejecting this response because:The vendor stated calling me when my attorney sent a letter requesting my $5000 deposit on February 16, 2017. We waited long enough since August 2016 to have our roof installed. I'm not satisfied with there customer service and I don't believe that Bow Tie will install my roof for another 8 months. I would like my money back so I can hire another roof contractor. My attorney sent another letter asking Bow Tie to refund our full deposit or we will sue. The contract that was sent to us back on August 23,2016 was a one page sheet.

I am rejecting this response because:My wife and I would prefer a call back from the company's owner at this time since getting through by phone to your company is almost impossible. I agree that no one can control the weather, but your company can certainly control the number of jobs you take on at a time you know you’re falling so behind because of “el Nino”. Also, you using line item #9 as a loophole for keeping thousands of dollars of people’s insurance money is unethical and doubt that's what the owner intended. In our case, your rep did not even show to meet the adjuster, and I cannot imagine your company having used up $4678 of our money to buy and store our shingles since you’re so behind. Furthermore, with 20,000 holes in a normal roof plus the additional time it’ll take you to replace our roof, who’s going to be responsible for any additional damages incurred while waiting? And, just to add insult to injury, our insurance adjuster called us in February to say he’s closing our file because your company has already submitted paperwork on our house stating the work has been completed! Unbelievable… Kindly have the owner call us as soon as possible.

I have in your file that you signed a contract with [redacted] on 10/29/15 with a down payment of 3144.44 to secure your spot in our list of roofs to construct (we have 100 revolving at all times). As per the agreement signed on 10/29/2015 it has stated we are 5-7 weeks out with wonderful weather, and as you know we have had an el Niño weather pattern this year and it has been unpredictable to say the least. Everyday it calls for rain we have to halt production (20,000 holes in a normal roof, a lot of leak points, and we don't want your house to leak). Again we are sorry for the delay and will construct your roof as soon as time and weather permits. You are currently #12 on the list so we will start construction very soon weather permitting. scheduling issues? We are not a scam, we are not a fly by night company, we are not taking advantage of the elderly, we are a good company that has a extremely long back log. The storm in San Antonio damaged 700K roof tops in one short week, and has been a blessing for our business and a curse. We currently construct 15-20 roofs a week with the same crews, we did not add unqualified crews like some storm chaser company. Sounds to me that your frustration is all directed to the communication from our office (i will look into this). We have been running and continue to run at full speed to get to these projects in order of the contract date. You currently are very close to the top of the list, materials have been ordered, and schedule is tentative of the weather. I hope you can understand. We have faced some unavoidable situations over the last several months. One being the weather, as per the construction process and checklist sheet you signed, it states 5-7 weeks out if weather is wonderful. The contract was dated 8/24/16 with 5-7 weeks out, that would have put us installing your roof the week of OCT 10th with wonderful weather. According to NOAA we had one of the wettest falls in recent history. Our weather plan states if it calls for 30% or more we will not roof, when the weather calls for a percentage this means that that percentage of the coverage area will get rain. When we have rain in the forecast every other day, most roofs take 2 days, we have to be careful of striping a roof with chance of rain. Everyday we can not roof, we get behind 3-5 roofs. It becomes a multiplication effect, and compounds. We are finally getting leveled out, production wise, we just got an overload of work in a short amount of time. We thought we were ready for the huge influx in business, however with any growth there are pains that we didn't foresee. We are currently implementing procedures so the next go around is smoother. This year has been a crazy year for weather as you well know, we have had more rain than most (spring), now its hot and the guys are working at a slower pace. The biggest reason for the delay is on 4/12/16 San Antonio received the biggest hail storm in history with 2 Billion in Damage, softball size hail, so this created a huge backlog with the suppliers, labors, and emergency situations in and around SA. As you can only imagine having holes in your roof and decking would be a nighmare. Everything is starting to level out now, suppliers are not as far out and labor is starting to become manageable. We have you on the schedule to have your roof installed in a few weeks. Your roofing material is ready we are just waiting on the crew to finish a couple of jobs. Mr [redacted],After review of your file I have found some discrepancy’s in your statements. The contract we had with you was $10,479.28, and was for what the insurance called for, on the scope of work from your insurance company, valley metal was not present, however they did call for rain diverters....
Rain diverters are either a strip of metal over an ac unit, patio, or the last 3 feet of a valley to take water away from the corner. If valley metal was present at the time of insurance inspection, it would have been noted at that time. It is standard practice by home builders to include just a rain diverter in the valleys, the valleys after further review as installed up to Owens Corning installation standards (please look at the attachment from the installation book from Owens corning). We install by the manufacture standards to insure the material warrantee will be valid, if needed. Valley metal, storm guard, or other valleys is an upgrade, however it is not required in installation of an Owens Corning product. When we address any roof we follow your insurance companies scope of work and have fulfilled the scope. At the time of the inspection with [redacted] and Myself we evaluated the valleys and had to take an educated guess of the installation of valley metals. [redacted] walked your roof, walked down the valleys, and concluded it was plausible that valley metal was present. We made an educated guess do to the fact, metal present at the eves, what appeared to a little rise in the shingles signaling valley metal, storm guard or felt laid down the valley. Once you called about a leak, we came out, tarped the roof, and replaced the valley even though it was a separation on the decking, and rafters. This happens in Texas, from hot – cold, humidity, and wet- dry conditions in the attic. This was the cause of the leak, not roof issues or lack of valley metal. We did the repairs without charge. The other valley in question has not leaked and is not in question. Workmanship warrantee is valid to improper installation, and after review the roof was installed correctly. In my professional opinion, I would not disrupt the valleys unless there is a problem, the shingles have sealed though out the summer. Unfortunately, as houses shifts, inclement weather and other unforeseen issues this causes leaks in any roofing system over time.I would also like to address the issue of the text at 11.03 at night, we are open durining normal business hours, unless there is an emergency.
