Thank you for your inquiry concerning [redacted] application for our Apartment at [redacted] We are sorry to hear Ms [redacted] is dissatisfied with our policies regarding her ApplicationOn Monday, October 4th 2016, Ms [redacted] showed up to an open house showing at the apartmentAfter she was given a tour, Ms [redacted] said she "loved the way the apartment felt" and she'd like to take itMs [redacted] filled out and signed a Rental Application and presented two checks to us ($application fee and $deposit) thereby entering into a contract with us, and she agreed to rent the apartment upon approval of her applicationThe terms of the application agreement are clearly stated on the application that she signedWe took the apartment off of the market, stopped advertising and showing the apartment for rentWe did not offer the apartment to any other prospective new tenantsLater the same day we emailed Ms [redacted] requesting additional information from her that she had not supplied on her written applicationOn October 10, 2016, Ms [redacted] withdrew her applicationThe terms of the Application clearly state if you withdraw your Application, you will forfeit the Application Fee and Earnest DepositWe followed up with a certified letter to Ms [redacted] , stating that she had breached the contract, and as a result we had suffered damages (lost rent, cost of remarketing the apartment, etc,) We also supplied her a copy of her signed ApplicationWe are [redacted] a copy of the letter we sent to Ms [redacted] We are currently attempting to mitigate our damages by finding a new tenantWe will be applying Ms [redacted] application fee and her earnest deposit to the actual costs we incurShould there be a credit, we will refund it to her
