Family Fence

Jeff *** came to my house to give free estimate on vinyl fence installation. We agreed to have his company do the job and gave Him a $2300 check deposit on 01/08/20 (which was cashed 01/10/20), half the cost of the fence install. We pulled our own permits. He scheduled initial install in March and since then has rescheduled us over 7 times. But only after we contact him after not showing up the day he was scheduled to come install. He doesn't ever reply to his phone calls, texts or emails. He'll randomly call at his convenience (After a few days or even weeks) with a cheap excuse wanting to reschedule again. We decided to cancel after we realized that he had no intention on installing our fence. We mailed a certified cancellation letter to the address listed on his "so called" Notice Of Commencement contract asking for our $2300 deposit refund within 14 days of receipt, but the letter was returned back with not a valid address for the company stamped on it. We realize there is another address under this business and on the actual city permit and plan on mailing the certified cancellation letter there as well to see if it is a valid address for this company. We emailed a copy of our cancellation letter and received a reply that our refund would be processed within 14 days. We never received our refund and it has been 30 days since that email conversation. We then again emailed him asking about our refund. He hasn't responded. We've sent texts and have even called and get no response. We plan to take this to small claims court. I just looked him up on *** and there are similar issues from others.
