Review: MY COMPANYS GENERAL LIABILITY INSURANCE WAS CANCELLED. AN ADDITIONAL AMOUNT WAS PAID FOR ADDITIONALLY INSURED AS INSTRUCTED BY THE AGENT AND THE CARRIER, ESSEX INUSURANCE COMPANY FAILED TO CONTINUED WITH THE POLICY. THE AGENCY HAS STATED THE POLICY WAS CANCELLED DUE TO THAT NONPAYMENT WHICH WAS PAID.Desired Settlement: I EXPECT A REFUND OF 587$ OR THE POLICY REINSTATED. THE INSURANCE COMMISSIONER IN BOTH STATES WILL BE NOTIFIED OF THIS SITUATION.

Per our phone our phone conversation today, since we had originally talked earlier this week, we have taken this time to investigate what has transpired between the agent and the insured regarding the policy in question.

We have found out that there was confusion and misunderstanding between the agent and insured over the policy in question and the coverage/endorsements that the claimant needed.

We are making an individual, special exception in this case to waive the 25% minimum earned premium that was applied to amount of available premium for return at time of cancellation. This minimum earned premium is a condition of the policy terms and was presented at time of quoting. We are then going to adjust the cancellation return premium to be based on a pro-rata basis, or as better described as an amount that represents the actual time the insured’s policy was in force.

Our accounting department is making this transaction occur.

We are notifying the agent of this action.
