On May 31, 2016 came in to Equity *** to look at a car for my son. Excellent customer service from sales representative while picking a car. We found a nice car that we liked and were told that the price is not negotiable due to the quality of the cars that are for sale there. While I was signing the contract I was told that the car was a buy back. I asked what that meant, and was told by sales agent that since it had minor transmission problems and the original owner took it back to the dealer. The dealer fixed the car and owner was still not happy so the dealer bought the car back. Then the sales person and the manager stated that this car in *** certified and it will be covered 100% bumper to bumper. If I had any issues I could take it back to the *** dealer and they will be happy to repair. They also stated that the bank that approved my loan at 22.99% was kind of high but I will be able to refinance after 1 year. On 09/13/17 I applied for a loan from my credit Union and was I was approved by my credit Union at 4.5% but because this was a buy back car with a branded/restored title no bank will be able to refinance this car. They also advised me that per the car fax report, this car had been in accident and had front end damage. I called ABC *** on Camelback road and they stated that only *** can certify this car, but they will never be able to certify a Buyback or Salvage car. I love the car but I am not going to pay almost $18,000 for a car that *** dealer stated that is only worth around $2,000.00. I want Equity to buy it back and refund my down payment and total paid up to this month.

This letter is in response to a complaint filed by ***. Thank you for bringing this matter to our attention. Equity Auto Center has looked into this matter and found the following.

Mr. purchased a 2010 Nissan Altima on 5/31/2017 from Equity Auto Center. Equity Auto Center fully disclosed to Mr. that the car he was purchasing was a Lemon Law Buyback and has all the appropriate disclosure signed by Mr. Dominquez to prove it. Please see attached copies.

Mr. states that he purchased a salvage title and is wrong. Mr. purchased a “Lemon Law Buyback” not a salvage title that is a completely different thing. The Vehicle he purchased had a 12 month 12,000 mile warranty from Nissan North America Inc. Please see attached copies. There are some credit unions and banks that will finance Lemon Law Buybacks. As to the interest rate, Mr. was given the interest rate he qualified for at time of purchase based on his credit.

Equity Auto Center is willing to give Mr. KBB Trade in Value for the vehicle witch should be way more than $2,000.00 Dollars toward the purchase of another vehicle. Equity Auto Center will also match the interest rate of the credit union of 4.5% on approved credit.

I had been in contact with Californai Auto Finanace ***He was trying to verify from Management why they approved a loan a car that was financed with a branded title. I clearly was told that it was a buyback but based on what Equity explained to me was that it was a regular title. I would have never agreed to buy a car for over $12, 000.00 that would only be worth $5,000.00. My bank denied my loan solely because of the branded title.I also went to the Nissan Dealer to try to do a trade in and the Owner of *** told me that I got screwed.I would need to buy a new car and maybe with rebates I will not be upside down as much. signed the appropriate documents that were required as previously stated. Mr. can bring the car to Equity Auto Center and Equity will trade Mr. out of the car and give him a fair Kelly Blue Book trade in value for the vehicle based on condition, witch we be-leave to be more than $5000 dollars. Equity be-leaves that other dealers are just using sales tactics to pay less for Mr. trade in. Tony D ***

When I bought a car from them, they sold me a vehicle warranty. We cannot get them to activate it so that it is available to us. We also refinanced the car and are trying to get a refund of the GAP insurance they sold us. We can't get them to work with us to do this and the insurance company says that it must be done through the dealer. We would just like to get what we paid for and a refund for the insurance we no longer need.

I bought a car from this company and tried to return it about 20 minutes after I purchased it due to mechanical malfunction.They told me that all sales are final and under no circumstances would they take the car back. They said that they did not care about the condition of the car because I had already purchased it and now it was my problem. This is a shady company that does not stand behind anything they sell. I took the car directly to my mechanic. He said the tires were cupped (this is what made the humming sound) and they were at about 10% tread life left. He said they were in such bad shape that they were unsafe to drive on the road. The front rotors were completely warped beyond repair and all the rest of the brakes on the car were shot. I ended up putting approximately 1000 dollars into the car just to get it to where I could drive it safely. This dealership added things to my contract that I did not want or approve. They told me that they were going to put a new battery in the car and while they had the car in the shop they changed the tires on the car from the ones I took for a test drive to old worn out ones. This is all after I had already agreed to the sale. They knowingly sold me a car that was unsafe to drive and they would not stand behind their product.

Equity Auto Center has looked into the matter and found the following. Equity Auto Center sells used cars and they cannot be in perfect condition. Equity try’s to sell cars that are in the best working condition, to the best of our ability. Equity does give customer the opportunity to inspect and drive the cars before purchasing.

This is the first time Equity heard that Mr. had an issue with the car he purchased. We were never given the chance to inspect the vehicle before Mr. took matters into his own hands.

Our store policy is that before we can approve any repairs for a customer vehicle. The customer must bring the vehicle to our store so we may inspect and deduce what mechanical repairs are required. Since Mr. has already completed repairs Equity Auto Center is willing to give Mr. a good faith reimbursement of $100 Dollars.

Mr. may contract Equity Auto Center at *** to schedule a time to pick up his reimbursement.
