I signed a contact on or about 4-26-2012 with this company to get my crawlspace sealed to prevent water from rising . Within the last couple of months I had issues with the fan (placed under the house to circulate air) tripping my breaker box. So I contacted the electrician who connected the power. They informed me that due to water rising under the house (three to four inches) it was causing the fan to trip the breaker(safety switch) I contacted ESS to come out to check the water and rising they stated that it was not their problem.

Mr. did sign an agreement to do work on February 17, 2012. It was recommended that he seal the crawl space and install a dehumidifier. Mr. did not want to do the recommended action and chose to go with a vapor barrier only. The crawl space was not sealed. We also recommended that he install gutters and landscape extensions to get any rain water away from the home. At no time did Mr. reveal that he had a flooding issue. In addition it is stated in the agreement under exclusions that our solutions do not cover problems related to excessive flooding if this condition was not disclosed to us during the inspection. Furthermore under the Clarifications section of the agreement it was stated again that "it is understood, and we are under the impression that the home does not flood or have standing water present after a hard rain or the combination of a hard rain and high tide. Our recommendations are based on this understanding." With a vapor only job the workmanship warranty expires after a year and the only remaining warranty is by the manufacturer which guarantees the product to not tear or rip under normal use for 25 years. This job was completed eight years ago. Annual inspections were done on 08/2013, 09/2014, 05/2017 at the time of these inspections the wood moisture content of the wood was 15% or lower and we had no indication of bulk water in the crawl space. In March of 2019, a circulation fan was added to help circulate the air within the crawl space at the technicians discretion this was suggested. This fan would not keep bulk water from entering the crawl space. I am sorry Mr. is having some issues now, but we are not responsible as I previously stated what was in the agreement documents Mr. signed that specifically outlined that our work was based on the knowledge that the crawl space did not flood. Had we had that knowledge a completely different solution would have been offered to Mr.. As for moving forward we are happy to help Mr. fix his problem, but he will need to pay the same price everyone else does for those solutions. We stand ready, willing and able to work with Mr. if he so chooses.

That's all false information and unacceptable. I guess the next step will be small claims court
