July 28, 2015Dear [redacted]:I received the complaint that was filed with your office against me personally and against my company, Envirian of Warrenton, by a tenant of [redacted] condos in Alexandria, Virginia (the “Property”).The tenant and another individual entered into a lease with the...
owner of the Property (the “Landlord”) on May 4, 2015. My company, Envirian of Warrenton, and the Landlord are parties to a Property Management Agreement dated January 2, 2014, pursuant to which Envirian of Warrenton provides certain services to the Landlord with respect to the Property. My involvement and the involvement of Envirian of Warrenton in the matters leading to the complaint filed by the tenant are solely as representatives of the Landlord. The tenant is seeking an exception to the terms of the lease, something that is outside the scope of responsibility I have under the terms of the Property Management Agreement.Please remove this complaint from your files because it was filed against the wrong party. I fulfilled my responsibilities under the Property Management Agreement by informing the Landlord of the tenant’s concerns and by repeatedly engaging, at the Landlord’s expense, pest control services to resolve the tenant's issue. Despite the assurance of the pest control company that there were no longer any pests in the condo, the tenant asked to be released from the lease and for her security deposit to be returned. Both requests are outside the terms of the lease and are decisions reserved to the Landlord. The Landlord agreed to release the tenant from the lease but is unwilling to return the Security deposit.
