The executive sales director named *** came into our store last month and recommended a new machine for us to try and told us that we could cancel it anytime without paying any fees. So we believed in him and signed the contract.But after We used it for a week, we found this new credit malachite could not meet our requirements, so we tried to contact him to cancel the service. We called him many times and left massage, we sent him email. He didn't reply. Then we contacted the other department, we got answer that we need to pay cancellation fee. ***. Please help us to cancel the service.
Cancel the service and terminate the contract.
Merchant received acknowledgement of Terms and Conditions and was explained about all cancellation fees and penalties.
Problem with the terminal was solved and Merchant agreed to continue using machines at the location.
As per the agreement second part of installation of terminals will be done on Tuesday, May 7th, 2019.
We use *** for our merchant payment services and ***, sales director and principal of Empyrean Merchant Services Inc. approached us to offer cost savings on our credit card processing fees. It's the first time we were approaced by a broker and were intrigued by his sales pitch. The savings he offered sounded good and we filed an application to get approved. We advised Mr. we will not switch over from *** if same service is provided as *** in terms of next day deposits and he advised us not to worry since he is a broker it's not a fixed contract and that it is month to month and can be cancelled at any time. We signed a document and no copy was left. Asked us to take a photo of first page where the rates are shown but no details a given on contract or agreement.
A couple of weeks later Mr. brought over a terminal for us to start using. At this time we also advised Mr. we will try out and will not be cancelling *** if until we are convinced all services provided by *** are the same as ***.
After first day of usage we noticed the following morning the direct deposits had not hit our account. As a result we were charged several NSF fees by our bank for cheques the bank had processed. I called *** immediately and he advised me not to worry that the deposits will be there sometimes in the morning.
This is different than *** since *** is a division of *** where our business account is and all credit card deposits are done early morning together with the processed cheques. As a result we advised Mr. we wish to cancel the agreement. We were told we can use it for the rest of the month.
We used the terminal for the rest of the week and noticed on the first Saturday there were no Saturday deposits by ***. This was the final straw and contacted Mr. once again to complain and advised him we will no longer be using the terminal because the service is not as agreed. The office asked for a copy of the bank statement to show proof of Saturday deposit and this was provided by e-mail. No response from Empyrean.
A week later we received a copy of a lease agreement on the terminal for $70/month for years. This was never agreed on our side and we would never agree to any of this term. To this day we have yet to see a signed document by Empyrean or by ***. We asked to get one from both parites.
We contaced Mr. and after a *** e-mail he asked his secretary to arrange for a meeting with us on November 21st at 2pm. This date and time came and passed and Mr. didn't show us as scheduled. After an e-mail he replied that his secretary didn't book the appointment. He arranged for another appointment for November 27th at 1pm and it was 100% confirmed by his secretary and *** himself.
Seeking for Empyrean to close our account with *** and pick up terminal from our location. The terminal can also dropped off at their office. We have no use for it and did not agree to terms.

I'm waiting for a document that states our account is closed with ***. At this point it's only verbal and no paper record. As soon as we receive this we'll close the case.
