Failure to deliver products and, or services post receipt of payment.

Mr. Colin *** contracted with C. *** and M. M to provide videography services for a special event within the State of ***. Per contract, Mr. agreed to provide all raw footage of said event along with a "highlight video" and "documentary video" of said event in DVD and USB formats. Services were rendered by Mr. and payment was made in full by C. *** and M. M. However, none of the afore mentioned products were ever provided to C. *** and M. M. Multiple attempts were made to contact Mr. to inquire on the status of said products, without little to no response from Mr.. Per contract, Mr. was required to deliver all products 30-days post the date of service (Oct. 5, 2019). After multiple attempts to reach Mr. a text message was received from him on 12/17/19 stating, "I sincerely apologize for missing the calls and getting back to you late. I will send you proof of mail and expected arrival dates for the DVD and USB drive today." That did not happen and after further attempts to reach Mr. a message was received from him on 12/26/19 stating, "It was completely my fault with the false promises... I am going to do this first thing." It is now 2/6/202 and we have still not heard from Mr. nor have we received any of the material that we have paid for. In addition, our contract with Mr. states that C. *** "has and holds all rights to all material shot on select dates," and Mr. has unlawfully and without permission used video from our special event to advertise his products/services online.
