On 4/30/18, *** was to be at my house to give me an estimate for some work. He said he forgot about the appointment and would be out on 5/2 at noon. He finally showed up around 4 and we discussed what I wanted. He said he would communicate with me and get my estimate to me in a timely fashion. He said he would create a design for me that could be tweeked as much as needed before the construction started, so there would be no doubt about the finished product. This way we would be on the same page as to what the finished product would look like. He said it would cost me $300 and mentioned that since I was referred by ***, he was giving me about a 50% discount on the design portion of the work. I wrote him a check for $300 and he cashed it the next day. On 5/9 I emailed him asking how the design was going. His response was that he was finishing up one and I should get the design on 5/10 later in the day. On 5/14 I emailed him asking if the design was done and what the estimate was. He said the design was done but he was out of town. He told me he would send me the quote "shortly." On 5/21 I emailed him that I needed the design and estimate by 9 pm or I needed my $300 back. He sent me pictures of the design, around 10 pm, which looked nothing like the pictures I gave him, plus there still was no estimate. He told me that I would have to pay more if I wanted a more detailed design. On 5/28 I emailed him again. I explained that the design he sent me had no detail and looked nothing like the pictures I sent him on what I wanted it to look like. I also reminded him that I still had no quote. I asked for my $300 back since he did not provide me with what we agreed to, plus he never provided me with an estimate. Since he did not deliver anything he promised, I needed my money back. I got no response. I called him to give him one last chance to make things right but he refused to refund my money. I have spoken to *** about the type of contractors they are recommending.

Refund I would like a full refund of my $300 check. I feel I deserve this because Remy Genot did not provide me with the design we discussed. When I talked to him about the lack of details in the design, he told me that it would cost more for details. When the agreement was made, he told me that he would tweek the design as much as necessary so that we would be "on the same page" prior to the construction, so there would be no issues about what the end product would look like. He completely scammed me.
All paid for design work completed and emailed. Not only that it was done for 1/3 of the cost everyone else pays. If this client wanted more options then you simply pay for more design time. The real issue is I refused to bid the building portion because I felt uncomfortable with the client. She has been given a $900 design for $300 so this needs to be off my record. I can provide dozens of satisfied clients who I have designed for plus I hold National awards for my work. My reputation will not be tainted

The agreement for the design was that it could be tweeked as often as necessary in order to have the design that was discussed. This was so we were both on the same page prior to the beginning of the construction. When I asked for some sort of detail with the design he sent me, he told me it would cost more. He originally told me that he was giving me a discount because I was referred by *** Company. I did not ask for a discount, or the design, for that matter. If he felt uncomfortable dealing with me, why did he send me the design at all? He didn't send it to me until I asked for a refund on the 21st. He had told me that the design was complete on May 14th. I think he just admitted that he had no intention of completing the work. Because of that statement from him, it seems as if he threw together a design, so he could say he provided that to me. On May 9th his text message to me said the design would be done on May 10. On May 14th, his text said the design was done. I finally got the design on May 21st, very late at night. I feel I only got it then because I asked for the design AND estimate prior to 9:00 pm that day, or I needed my $300 back. His response to the May 21st text was "Not a problem." On May 23rd his response to my text asking for the labor part of the estimate was "Not a problem." On May 28th I text him that the design looked nothing like we discussed and agreed on. I asked for my $300 back since he had not lived up to his end of our agreement. I feel I was more than patience with this gentleman. I had another contractor do the work for me. I gave him the same pictures I gave Mr.. He did not offer, or supply, a design prior to doing the work. I am very satisfied with the waterfall and stream he created for me. I would like to be able to come in to visit with you in order for you to see the text messages for yourself. I was very patience and very understanding from the beginning. I did not ask for my money back until I got the distinct feeling I was being scammed. In my May 21st text message to Mr., I mentioned that I was beginning to think he had scammed me. I asked him to prove me wrong. Please let me know when I can come in to show you first hand the text messages between Mr. and myself.
