In May of 2019, I toured a Spec Home that was built by Eddy Homes and on the market. When I toured the property there was still work to be done. Specifically, in the Master Bathroom, it was plumbed for a two bowl vanity with a storage tower in the center of the vanity. I agreed to buy this house at *** at the end of May 2019.
On June 4th, my sister and I were walking through the house and took some pictures. One of them clearly shows the two bowl vanity already in place and awaiting the center storage tower for the vanity. A few weeks later, I was touring the house checking the progress while awaiting my closing date, and found the entire vanity was changed and only consisted of a one bowl sink and no centered storage tower - this was on a weekend. I went home, sent an email to Julia M a wife of one of the owners who was my point of contact - I inquired why the Master bathroom vanity was changed after we signed the Sales Agreement? I received an email back on Tuesday from Julia and she states that was a big mistake and it will be returned to the design we had seen during my initial tour.
A week or so later, I was back at the house and my Project Manager was on site and I asked him why my bathroom had been changed for a period of time - and he stated, it was done for inspection reasons. I had no reason to be suspicious or further question him.
I had my Closing on July 31, 2019. I've had several other major issues during this time, but, at the end of January 2020, I received a notice from The Allegheny County Health Department requesting I join them against Eddy Homes for selling me a home that did not meet State or County Health Code. This was the FIRST that I had heard of this and the County told me Eddy Homes should have contacted me and asked me to sign a Variance that would relieve them from having to rectify the Violation if I would agree.
I'm sure Eddy Homes knew at this point how frustrated I was with other issues and their lack of concern for resolving them and felt I would not cooperate. (I can provide an email that highlights some of my issues and cost to resolve one of them where I ended up footing the bill to resolve.
I sent an email to the Customer Care Department of Eddy Homes because you can not reach anyone by phone and I have never been introduced to the owners of the company. I suggested in order to save them a significant amount of work and money, I would accept them paying me $5000 and I would sign the Variance for them. In order to fix the problem in the Master Bathroom, the two drains for each of the sinks have to be 15 inches from the wall and they are not to Code. The way the bathroom is currently configured with the center storage tower and two sinks, they would have to rip the entire vanity out, narrow the storage tower and replace the Quart counter and move the plumbing. This could not be accomplished cheaply and without having to relocate my sister who is not able to walk steps well to use the upstairs shower while the work is done. I felt my offer was a fair offer.
However, Eddy Homes and my Attorney met a major road block when the only way Eddy Homes would agree to my request is if I signed a General Release stating I would not seek any further relief from them for anything that may happen in the future at my new home. As you can understand, with the issues I have already encountered, I am unwilling to waive or give a General Release to Eddy Homes.
I told Mr. M, their Attorney, that I would be contacting the Revdex.com and will certainly let anyone that would ask me, that I am very unhappy with the Customer Service and their desire to make things right - on a $525,000 new home. Mr. M advised my Attorney, Mr. Noah F that I should not threaten them and they would sue me if I attempted to ruin their name. I thought filing a complaint with the Revdex.com was a right - and I felt they were threatening me.
We appreciate the opportunity to respond to the complaint received. Customer satisfaction is of the utmost importance to our company. In this case, the issues raised by the customer have been discussed at length, including before closing. If the customer would like Eddy Homes to install a single-bowl sink, we are happy to do so. In addition, we can reimburse the difference between the single and double bowl sinks ($900). Alternatively, if the customer would like a double-bowl sink as we were told prior to closing, Eddy Homes will secure the required variance from ACHD. As this was the intention, Eddy Homes has already made payment to the ACHD and proceeded to secure the variance required. If the customer would still like to proceed in this manner, he need only sign the variance request.

Homes sincerely regrets any frustration these issues may have caused. To the extent there has been confusion over the variance procedure, we are happy to discuss again with the customer. However, we feel certain our efforts have met our contractual obligations.

not accept Eddy Homes' position. Documentation is provided to
highlight their inaccurate reporting of the details they have
provided to you. Firstly, I never had to request a double bowl vanity
as the home was built with one. See Exhibit A, Page 4 and that is how
it was presented to me on my very first tour at the end of May 2019.
See Exhibit B attached, showing the house was designed as such
effective March 26, 2018. Please see Exhibit D (1) showing the
configuration of Master Bathroom as under construction when I first
toured the Spec. home. On June 1, 2019, I signed the Sales
Agreement (36 pages) copy available upon your request. On June 22, 2019, I visited the home as
it was still being finished and found in the Master bathroom, the
original configuration had been changed and it now had a single bowl
installed and no center storage tower. See Exhibit D (2). I
immediately sent Julia M an email and expressed my concern as
to why the original configuration had been modified, and was not
requested or approved by me, the buyer. On June 25, 2019, Julia M replied
via email, indicating it was a huge error on Eddy Homes' behalf. See
Exhibit DI had my closing on July 31, 2019 and
I had no discussion with Eddy Homes regarding the Master Bathroom
before of after this date, once I saw it was restored to the original
configuration.Then on January 22, 2019, I am notified
by the Allegheny County Health Dept. that my Master bathroom is out
of compliance with both county and State codes. They requested I join
them as an Indispensable party. Due to many previous unresolved
issues, I agreed. Copy available upon request.There are other documents available
upon request and not sent due to size limitations showcasing that I
never made a special request to Eddy Homes pertaining to the Master
Bathroom. Therefore, I stand with my original

Eddy Homes regrets the frustration that these issues have caused. While we disagree with the customer's recollection of discussions that occurred before closing, we are still able to adequately resolve the customer's concerns.
In reading the customer's correspondence, it appears that he would like to keep the double-bowl sink. Eddy Homes has proceeded to secure the required variance from the ACHD and paid all associated costs. The customer need only sign the variance request, as he is now the owner of the property. Eddy Homes initially applied for the variance at the time it was the owner of the property. Now that the customer owns the property, he is required to sign.
However, if the customer does not wish to sign the variance, Eddy Homes is willing to install a single-bowl sink at its expense, and reimburse the customer for the difference between the single and double bowl sinks ($900).
We are happy to discuss these options further with the Bureau or the customer directly.

Eddy Homes continues to try to place the blame on me - their VALUED customer - as I have provided you with their own documentation showing this home was designed and built, outside of Allegheny County Health Department and State plumbing code, per the notification I received in January 2020.
The Spec Sheets for my property that I have from Eddy Homes are from 2018. When I first toured this property, it was late May 2019. The pictures I provided with the date stamp show what was already in the property when I toured. I had my Real Estate Agent from Berkshire Hathaway with me the day we toured and I am certain she would be happy to attest as to what was in the home. There is no problem with my recollection - and what they are saying is simply an untruth.
Does Eddy Homes expect me, you and anyone who will read this Complaint to believe they built and designed a $525,000 home with a single vanity? And that I had to specifically requested a double vanity when I have provided documentation from Eddy Homes admitting to the Allegheny County Health Department, and they provided specific address examples of other properties of theirs they either corrected or attained variances on before selling them because of this same Code violations?
My photographs clearly show the build of their Master Bathroom when I first toured this property prior to County Inspection. After the violation was found by the ACHD and they placed a Stop Work notice on this homesite, they TEMPORARILY placed a single bowl vanity (never altered the plumbing underneath). Then, in late June, I saw this change to a single bowl vanity and I questioned via email to Julia M about them making this change AFTER I signed the Purchase agreement (photographs provided). Attached is the email from Eddy Homes, written by Julia M a few days later, where she stated it would be returned to how it was supposed to be and wasn't sure why their "subs" made that change. So, I did not to have to request a double bowl vanity - and to try to indicate otherwise is an outright untruth.
I have provided documentation of THEIR Spec sheets from 2018, a year prior to me ever looking at this home and their email admitting the single bowl was a mistake. Plain and simple.
It is very unfortunate that Eddy Homes wishes to lay the blame on their customer for requesting a double bowl vanity. This all could have been avoided if Eddy Homes would have approached me, as any professional business should have done, and explained the situation and request that I sign the Variance for them - however, they attempted to obtain the Variance for themselves, after I purchased the home and the Allegheny County Health Department would not allow them to do so because I was now the owner and it was my decision to agree or disagree to approve a Variance. They knew at the time of my closing that my house did not meet both Pennsylvania and Allegheny County Health Department code, but proceeded with the sale to me. If the Health Department wouldn't have notified me 6 months after I moved in that my house is out of Code, I would have never known until I would have attempted to sell it and it be discovered at that time.
How does a layman identify problems or violations of Codes when touring a prospective home? You must have some level of trust in the work that is being done for you and my trust was ill placed in Eddy Homes.
If that is their final stance, what I will encourage any one who is considering a new home built by Eddy Homes is to not waive the New Home Inspection by a neutral party and to have all details specifically in writing and don't close until your home is exactly as you agreed to purchase.
I realize when purchasing a new home, you will have issues that need addressed and you work through them with your builder. I have several other outstanding issues and am anxious to see them resolved. To this date, NO ONE from Eddy homes has ever personally came to speak to me or even sent a letter regarding this Code Violation. In fact, the owners have never introduced themselves and I live just a few steps away from their Model Home.

I want to provide you with some information that I learned today, Wednesday, 5/20/2020 from *** of Pine Township. *** visited my property for a totally different issue and upon ending his visit, he inquired how my situation with my bathroom was resolved. I explained that I had submitted my information to the Revdex.com for review and was awaiting a reply. *** said that Pine Township had to provide all documentation to the *** He stated that they were looking into the plumber and Eddy Homes as they felt the Inspection that was provided to *** This is what I was told.When I first started to investigate this Allegheny County Health Department Code Violation, I contacted Pine Township and asked how I was permitted to receive an Occupancy Permit if the house was not Inspected. Pine Township provided me with a copy of the Final Inspection they were provided, but the County did not have a record. I forwarded that to ***. I also learned from the Health Department that my toilet was installed properly, but not by a certified plumber. (?)I have attached a copy of the "Inspection" slip that they (plumber or Eddy Homes) provided to Pine Township, for your review. ***In light of all this very questionable activity by Eddy Homes and their contractors, I hope it is clear that I never requested to have a double sink vanity in the Master Bathroom, because the house was built and sitting that way when I first toured it. Any insinuation that it was done at my insistence is a complete lie. You can verify from the Spec Sheets I provided as an attachment this is how this home was designed and ultimately built. Then, suddenly a single sink bowl appears after a Stop Work order was given by the ACHD and then just as quickly disappears when I question it to Julia M - her stating it was their subs error. I think something more underhanded was happening, and I resent that they are trying to put the blame on me for installing a two bowl vanity. Eddy Homes has still never contacted me to inquire or explain how they would properly, and to Code, install a double bowl vanity - they simply say they will put in a single bowl and refund me $900! Not acceptable - additionally, a single bowl vanity would require restructuring the bathroom sink, as there is a centered storage unity between the existing two bowls, and more importantly, I don't want a single bowl. They are offering no resolution that does not negatively impact the value of my home - ultimately, after I purchased their home.Because they have treated me so poorly and Eddy Homes never notified me of the Code Violation, and I first learned of it at the end of January 2020 when I received the notice from the Allegheny County Health Department, I am not willing to simply grant them a Waiver. I closed on my home on July 31, 2019 and in all that time that passed, and from the date I signed the Purchase Agreement at the beginning of June - they failed to reach out to me and explain the problem they found themselves in. I truly appreciate having this avenue to vent my frustrations and to bring attention to their unethical behavior - perhaps saving others from this same aggravation. They have totally ruined the thrill of me purchasing my very first home at the age of 56 years. Shame on them. In closing, feel free to reach out to anyone at Allegheny County Health Department to obtain any specific details you may need. I recommend anyone buying a home from Eddy Homes to NEVER waive a new home inspection and to be sure everything in detailed in writing and completed PRIOR to their Closing. It is sad, because I love the style of my home, design, location and neighbors, but to know I was lied to and kept in the dark about a $525,000+ home, is insulting and wrong. [In response, there are some major issues that since come to light. I am glad they have acknowledged this double bowl vanity was not at my insistence, rather by their design.
1. I need to know if my entire home was ever properly inspected and if not, I want to obtain my own home inspection and have Eddy Homes reimburse me for the cost and any issues identified.
2. If a legitimate inspection was not completed, the problem I have with it taking over 3 minutes to get hot water to my kitchen sink needs resolved with a recirculatory pump.
3. Of course, I want to keep my double bowl vanity as built - however, Eddy Homes needs to present me with a re-design plan that meets my approval with aestethic and value and meets Code - not simply ask me to sign a Waiver - they need to make it right, or see number 4.
4. If Eddy Homes would prefer to not have to redesign the Master Bathroom and pay for reconstructing it to bring it up to Allegheny County Health Department Code and State Code, I would accept $5000 and I would sign only the Waiver for the ACHD. I will NOT waive my new home Warranty or sign a General Release. Seems to me, very unprofessional for them to request that of a new home owner.
Also, as the Revdex.com may be aware, the Allegheny County Health Department is continuing to research the actions of Eddy Homes and the plumber. I anxiously await that outcome, as well.

Yes, they are correct, I do want to keep the double bowl vanity.
However, it appears, again, that they are missing the point here - I want my Master Bathroom to meet ACHD and PA Code as SOLD to me, having a double bowl vanity.
Eddy Homes has still not reached out to me directly to provide any drawings or plans on how they will accomplish this task and correct the Code Violation - and not by me signing away their responsibility to correct their mistake or make amends.
It is obvious Eddy Homes want me to sign the Variance to make this go away. The fact remains their home was designed and built out of Code. This was not my fault and they were aware of this prior to my closing on 7/31/2019 and went on to sell it to me in a Code Violation state. I found out about it 4 months after I moved in to this house from the ACHD - had this matter been addressed with me prior to closing - we would not be having this discussion. I feel that was deceitful.
The documentation I provided from Julia M stated it was their error. I never received an explanation why the double bowl temporarily disappeared and was replaced by a single bowl vanity for a "short period" - and then the double bowl reappeared shortly after my email to Julia M, but, none the less, I was sold a home they knew was out of Code and they want the easy way out.
So, again --- I will sign a Variance for their error in design and construction being out of code when they pay me $5000. I would agree to not pursue any other issues regarding the Master Bathroom vanity. I can then entertain having the work done on my own time, as I actually would prefer not to have them do the work.
Plus, I have already incurred attorney fees for this matter and my position will not change.
In regards to the Master Bathroom, as has been previously communicated to Eddy Homes, in order to resolve their design and construction error, and knowingly selling me the house out of Code and without an Inspection to satisfied Allegheny Health Department and PA Health Department Code - there are three options: 1. Eddy Homes correctly redesigns the vanity and center storage tower to accommodate a 2 bowl vanity (as any normal Master Bathroom should have), or2. I hire a contractor/plumber to bring it up to Code at Eddy Homes expense, or3. Eddy Homes gives me a check for $5000.00 and I sign the Variance for only the Master Bathroom. I need to have this resolved and my house made whole - and not by me signing a Variance that relieves Eddy Homes of their responsibility of selling me a home that fails to meet Health Department Code. I, Eddy Homes customer, deserve better than to be treated as if this is my fault and I should roll over and play dead. I understand the County is further pursuing this issue and would think Eddy Homes would want to try to do right, by not only me, a "valued" customer, but in the eyes of the Allegheny County and PA Health Departments. Imagine how I felt in January, when I had to learn, via a letter from the County that my new home is out of Code. Eddy Homes was to be in contact with me regarding this and of course, no one from Eddy Homes ever discussed this problem with me. Since I was obviously a non-priority, and because of the many other issues I have had to deal with at my new home, and the cost I incurred to fix my back "feature wall" that Eddy Homes wouldn't do to hold true to their word- my back wall was rebuilt, AT MY EXPENSE, the landscaper found no "french drain piping" in front of or at the rear of your wall - I was assured there was a french drain at the base of the back hill and around my patio slab. So, in light of all the prior issues, over three minute wait to get hot water to my kitchen sink (still an issue), a drain pipe buried in front of my house was running up hill rather than downhill to the main drain to the street which caused my front gutter to overflow, also Eddy Homes failure to bury a down spout and allowed it to drain directly onto the driveway (I was informed by Pine Township that was not within Code and since Eddy Homes agreed to bury it, they would not get involved), my back gutters not being secured properly and water poured down behind them directly down my outside windows and walls, and last - but not least, the Master Bathroom Code Violation. Your treatment of me caused me to agree to co-join the County in their case against Eddy Homes.The sad part of all this is, I feel my home is very attractive, great location and have fantastic neighbors - but there is only embarrassment when I tell people who my builder is - in my years at the gas company I had heard good things about Eddy Homes, but, I guess everything changes. So many of my neighbors have similar horror stories. Shame on Eddy Homes for treating me so unprofessionally and making this such a terrible time in my life. At least I know it is not me being unreasonable - as I now know you treat everyone horribly, after the closings occur. So, in closing, the item regarding my Master Bathroom and the "Materials and Workmanship" Warranty remains open and unresolved. Eddy Homes needs to satisfy me, their valued customer by choosing on of the 3 resolutions outlined above.
Unfortunately, we are unable to offer anything other than what was communicated in our last offer. We are willing and able to secure the variance as requested in the customer's option #3. However, we are not able to offer the additional compensation of $5,000, as, once the variance is obtained, there is no cash payment necessary to resolve the issues set fort in the customer's complaint.

A reputable builder would do what it takes to ensure my house is up to Code, and should have done so prior to my Closing date, which is now exactly 1 year ago, today, 7/31/2019.
Since Eddy Homes failed to do so, the only remedies are:
1. Reconfigure my Master Bathroom to allow for the double bowl vanity which was part of their original design and to which I agreed to purchase this home at ***
2. Allow me to make my own repairs and provide me with $5000 to resolve THEIR issue and I will sign the Variance that the County would provide to me - since the builder never approached me to sign this in the first place.
Eddy Homes and/or their plumber placed me in a position where I now being forced to either sign the County Variance or live with THEIR mistake. No reputable builder would do this to their customer.
Accepting a single bowl vanity is not feasible as on top of my vanity there is a Center Storage tower and Eddy Homes has NEVER contacted me to explain how they would attempt to correct THEIR error with structural changes. Instead, they offer a single bowl (which wouldn't be centered and unacceptable esthetically) or for me to simply sign THEIR mistake away with the Variance that the County would provide.
This back and forth is simply repetitive and my position remains, as outlined above. It is very apparent Eddy Homes has no concern for me, or their reputation when they will not accept responsibility for their flawed design that placed my Master Bathroom out of Code and they proceeded to sell me the property in state, knowing it was out of Code.
*** can you please assist in coming to a decision on this matter - this is a very stressful situation and has caused me undue aggravation. Shame on Eddy Homes.
