Review: eCycle, Inc. failed to deliver 3 motor prototypes for which they accepted order and full payment on 2011.08.04. eCycle failed to deliver goods within stated delivery period (8-12 wks) and they haven't resolved the issue until present. Several requests for delivery or refund were ignored. On 2012.05.04 eCycle adviced us in writing that "WE WILL NOT PROVIDE YOU WITH ANYTHING, MERELY SO YOU CAN THINKER".Desired Settlement: ECycle, Inc. shall issue a full refund of USD 9,810 to [redacted], [redacted].

I am rejecting this response because:

eCycle accepted a Purchase Order and a full payment for the delivery of 3 prototype motors. This was a legally binding contract. Ecycle failed to deliver goods.

There was no contract or promise to buy any more of the eCycle products.

The evaluation of the 3 prototype motors would be a starting point for any discussions about further purchases.

Everpower expects delivery of goods or refund of payment.
