Shortly I received a phone call from Mark the owner He said that I couldn't cancel the contract because I was past my day cancelation period I explained the date on the contract was incorrect and his salesman had purposely back dated the contract Mark said he would match the other company's lifetime non-prorated warranty At this point with them not being upfront about their warranty, Don telling me incorrect information about [redacted] and also back dating the contract I had lost all trust in Ecotech How could I trust them in my home, trust the windows had the proper films and gases were between the panes after lying and back dating the contract!!! Mark said I only had choices, proceed or forfeit the down payment I explained I just wanted my down payment and he wouldn't listen [redacted] Don then phoned me, I advised him that my lawyer asked all further contact be in writing and I never heard back from Don The down payment had gone through on my MasterCard (the day after I said I signed the contract) I called MasterCard to dispute the claim and explained the situation They immediately removed the charge from my card and asked me to send all the evidence which I did MasterCard investigated and Ecotech has refunded the money back to MasterCard 1) Always check the date on the contract Date your signature! 2) Use a credit card, if there is a problem they will investigate 3) Read the back of the contract before you sign 4) If it says Lifetime warranty ask what does that mean and compare to others that say this 5) All correspondence should be in writing and dated (email is great for this) and keep it

I asked Don to come back to demonstrate his windows which he did and I again asked about the lifetime warranty. Ecotech's quote was higher but I was satisfied as to why it differed from the [redacted] quote. Don just happened to have a pre-prepared contract. I looked the contract over making sure all the windows, types, openings were correct. He calculated a 40% down payment. I signed the contract to purchase the Ecotech windows.
Later that evening I looked on the back of the contact and it said "limited lifetime warranty pro-rated 20 years". (Year 1 0% homeowner 100% Ecotech and by year 20 90% homeowner and 10% Ecotech) Very different than what Don told me and on Ecotech's website it just says "Lifetime Warranty" no explanation.
I contacted Don but he had a death in the family and it took a while for him to respond. Don said he would speak with the owner. A few days later Don said the owner wanted to know what exactly was the problem with the warranty. I again explain about the limited lifetime 20 years pro-rated warranty. As I waited for my reply I contacted 2 other companies that quoted me and ask about their Lifetime Warranty both said lifetime is lifetime as long as I own the home, non-prorated no number of years. I asked the [redacted] company about what Don had said about their quote which turned out to be false. I wanted triple pane windows but Don said that the basement windows were too small and that nobody could do them as triple. The [redacted] company told me that was false that Echotech just didn't have to proper equipment to do this. Don also said they quoted me a picture window not a casement window which also false.
On 8 day after signing the contract I hadn't heard back from Don so before my 10 day cancelation period ran out I decided to cancel the contract. I emailed Don and told him I was canceling the contract, the next day I also wrote a formal letter and faxed it to Ecotech canceling the contract. I then noticed the date on the contract was not the day I signed but was backdated 11 days. It was back dated to the day before I received my first quote. How could I sign a contract before I even received the quote?
Shortly I received a phone call from Mark the owner. He said that I couldn't cancel the contract because I was past my 10 day cancelation period. I explained the date on the contract was incorrect and his salesman had purposely back dated the contract. Mark said he would match the other company's lifetime non-prorated warranty. At this point with them not being upfront about their warranty, Don telling me incorrect information about [redacted] and also back dating the contract I had lost all trust in Ecotech. How could I trust them in my home, trust the windows had the proper films and gases were between the panes after lying and back dating the contract!!! Mark said I only had 2 choices, proceed or forfeit the down payment. I explained I just wanted my down payment and he wouldn't listen.
[redacted]
Don then phoned me, I advised him that my lawyer asked all further contact be in writing and I never heard back from Don.
The down payment had gone through on my MasterCard (the day after I said I signed the contract). I called MasterCard to dispute the claim and explained the situation. They immediately removed the charge from my card and asked me to send all the evidence which I did. MasterCard investigated and Ecotech has refunded the money back to MasterCard.
1) Always check the date on the contract. Date your signature!
2) Use a credit card, if there is a problem they will investigate
3) Read the back of the contract before you sign.
4) If it says Lifetime warranty ask what does that mean and compare to others that say this.
5) All correspondence should be in writing and dated (email is great for this) and keep it.
