I am rejecting this response because: I am requesting that the complaint be reevaluated and that Di-Tech be forced to answer why they responded to the Revdex.com the way they did Di-tech responded with the letter to the Revdex.com stating “at this time, Ditech has made no reporting to any of the credit agencies(EXPERIAN ” This is a statement and I have evidence to support my claim As I predicted when we talked, based on my past discussions with DiTech and what I consider to be shady business practices, upon my call to Di-Tech, they claimed that “although they had not file any complaint at that time(time of the Revdex.com response letter), after further review, they’ve decided to report the late payment to the credit agency.” I have attached a screenshot from my FreeCreditReport.com reflecting the credit cycle of my credit report; adjusting in December from their initial report, increasing from their removal of it, and then decreasing again after it they had sent the letter I have requested a December and January report from Experian showing their report in December, their removal of the reporting in January and then the February report (attached) showing them again putting the report back onto my credit report I have also attached a copy of the February report showing Di-Tech reporting of a late payment It appears they purposefully removed the reporting to make a “non-reporting” statement in January to the Revdex.com Then, after this complaint was closed, again report an inaccurate late payment to my account Please let me know what further is needed from me to support this complaint Thank you!

events that led to his unpaid principal balance to be increased at the time of the modification and the current status, we have provided a chronology of events below:On December 20, 2007, a Promissory Note was executed by [redacted] A [redacted] securing a loan amount of $417,The execution of this loan reflected a maturity date of January 1, 2038, which meant Mr [redacted] was to repay the full debt by this dateA review of Mr***'s loan confirms that his loan was also originated as a non-impounded account, which meant that he was responsible to maintain and keep the property taxes and/or the hazard insurance up to date.On May 22, 2009, the previous servicer GMAC Mortgage, LLC (GMAC), disbursed $17,for delinquent property taxesThis disbursement of funds created a negative escrow balance of $17,Additionally, Mr [redacted] failed to continue to tender the contractual mortgage payments after March causing the loan to become delinquentOn December 17, 2009, GMAC offered Mr [redacted] a Payment Reduction Plan Agreement as follows: 1st payment: $1,due on 01/01/2nd payment: $1,due on 02/01/3rd payment: $1,due on 03/01/4th payment: $1,due on 04/01/5th payment: $1,due on 05/01/6th payment: $1,due on 06/01/Based on the Payment Reduction Plan Agreement, each payment was due on or before the due dateA review of GMAC’s payment history shows that the following payments were the account was contractually due for the July 1, payment and had a negative escrow balance of -$43,The account continued to be a non-escrowed account, in which Mr [redacted] was still responsible to maintain his property taxes and insurance up to dateAdditionally, GMAC did not inform us that a modification offer had been extended to Mr [redacted] prior to the transfer of his accountOn April 20, 2013, Mr [redacted] was considered for modification after the receipt of a complete Borrower Response PackageAt the time of the modification evaluation, Mr***'s gross monthly income was validated as $10,On April 23, 2013, a Trial Period Plan was offered to Mr [redacted] that required three (3) trial payments: 1st payment: $4,by 06/01/2nd payment: $4,by 07/01/3rd payment: $4,by 08/01/Please note that the investor of Mr***'s loan, Fannie Mae (FNMA), deemed the trial payment of $4,as affordableIn addition, FNMA required that all of Mr***’s monthly payments include a monthly escrow paymentIf the mortgage loan being considered for a modification is a non-escrowed mortgage loan, the servicer must establish an escrow deposit account prior to the beginning of the trial periodThe servicer must ensure that the trial payments include escrow amounts and must place the escrow funds into a separate account identified for escrow depositsAt the time of the trial period offer, an escrow account was activatedSince Mr***'s loan was still considered a non-escrow account, our third party property tax vendor conducted a real estate search and identified that the following property taxes were still owed: property taxes of $10,property taxes of $11,On June 24, 2013, the above listed property taxes were disbursed from Mr***'s escrow accountBased on the Real Estate Property Tax information breakdown from the County of Palm Beach, Mr***'s property taxes were paid in full at that timeOn August 26, 2013, a permanent Loan Modification Agreement (Agreement) was mailed for Mr***'s executionThe Agreement reflected the following terms: New Unpaid Principal Balance: $554,Fixed Interest Rate: 6.1250% Principal & Interest Payment: $3,Monthly Escrow Payment: $1,Total Mortgage Payment: $4,Effective Date: 08/01/Maturity Term: 08/01/2053The capitalization of the loan was based on the below breakdown: Beginning Unpaid Principal Balance: $408,Capitalized Interest: + $93,Escrow Advance: + $43,Corporate Advances: + $9,Modified Unpaid Principal Balance $554,Please keep in mind that Mr***'s loan was contractually due for the November 1, through the August 1, payments at the time of the finalization of the modificationIn our April 5, correspondence, a payment history was enclosed that outlined the application of funds towards the delinquency owed when the modification terms were applied on September 19, After further review, it has been determined that the escrow disbursements processed by GMAC totaling $43,were included in the modificationHowever, a subsequent negative escrow balance, in the amount of -$25,was not included in the capitalization of the modificationThis negative escrow balance was a result of the property taxes and insurance disbursement proceeds from May 29, through August 8, In the event that these monies had been included at the finalization of the modification, Mr [redacted] would have seen a total Escrow Advance of $69,449.30, which would have resulted in a higher Modified Unpaid Principal balance of $580,Additionally, Mr [redacted] would have been required to pay interest at 6.125% on the additional $-25,over a month termAs explained in our correspondence letter dated April 5, 2016, Ditech has spread the current escrow shortage/ deficiency over a month periodThis escrow shortage spread does not require Mr [redacted] to pay interest on the escrow deficiency on the Modified Unpaid Principal balanceA review of Mr***'s loan confirms that he was considered for a modification on March 11, During the modification evaluation, it was determined that the gross monthly income was validated as $2,As previously mentioned, FNMA requires that all of the customer's monthly payments include a monthly escrow amount when considered for modificationMr***'s escrow account is established to pay the following escrow items: Tax Collector/ Agency Installment Estimated Disbursement Amount Parcel / Policy NoUniversal P&C Insurance Hazard Insurance Annually $6,Wright National Flood Insurance Annually $Palm Beach County Tax Collector Annually $11, Total $18,243.06Based on the annual estimated disbursement amount, Mr***'s base monthly escrow collection would be $1,along with a cushion of two months of the base escrow amount this would require an escrow payment of $1,Ditech would be unable to extend an affordable modified payment with Mr***'s gross monthly income of $2,Additionally, Mr [redacted] was mailed a decline letter on March 11, 2016, that provided him the modification reasons along with a Notice of Property Value reflecting a value of $978,At this time, Mr***'s loan is contractually due for the August 1, payment and all subsequent payments, with an unpaid principal balance Actuarial Amortization Schedule was completed on October 12, 2016, and a request for an Actuarial Payment History was completed on October 25, Pursuant to Mr [redacted] 's correspondence, we have researched an "acutuarial statement" and have been unable to find a definition that corresponds with Mr [redacted] 's request; therefore, we are unable to provide an "acutuarial statement" or an actuarial statementMr [redacted] 's account originated on October 23, 2014, as a fixed interest rate, first lien loan, in the amount of $126,The interest rate for his loan is 3.756%The regular monthly principal and interest payment is $The account is escrowed for the payment of hazard insurance, flood insurance and property taxesThe loan uses actuarial interestActuarial interest is a very common type of interest for many loansThis interest is based on a 360-day year with twelve day monthsJust like simple interest, interest is charged every day that the customer is using the loan investor's money, however, with actuarial interest, no matter when we receive the payment, days of interest will be taken out of that paymentIf we receive the payment days late, there will still be days of interest taken out of that payment, however if the customer pays ahead by a month, even though there has been no interest earned for the future month, we will take days of interest out of the paymentThis form of interest results in a gradual reduction, over the schedule repayment period, in the amount of the principal and interest payment that is applied to interest and a corresponding After several phone callsDitech was still unable to tell us why the bank draft had been cancelled and unclear on the balance of our loan They kept us confused and anxious about the status of our mortgage which was paid in full at this time This should never have been reported to the credit bureaus and Ditech should act quickly to remove that from my credit history They told me they would not remove it

I am rejecting this response because: Ditech's response shows numbers which do not match the Payment History available through my account on the Ditech website I've made a PDF of the Payment History and attached it to this correspondence.The attached PDF'd Payment History shows that between 11/26/and 12/06/the Principal Balance on my account increased from $85,to $86, This is an increase to my Principal Balance of $1,for the "reallocation." This is where I first noticed Ditech had made changes to my account (without any prior correspondence regarding their errors) on 12/31/16.Furthermore, Ditech's response included account activity which shows my principal balance to go as high as $88,on 12/06/16, but that is not reflected in any of my online statements, nor is it reflected in the attached Payment History Please explain the $1,increase to my Principal Balance as reflected on the Payment History for my account (attached)
a Modification Agreement was offered previously; however, at this time, the agreement has been terminated by the investor of the loanA review of the account has concluded that after submitting a complete borrower response package for an assumption of the subject propertya trial period plan was approved on March 10, When this trial plan was complete a final Modification Agreement was offered on August 12, for which it was necessary to schedule an assumption closing meeting in which the documents would be signed and notarized in the presence of a certified attorneyDitech scheduled meetings for both September 1, and September 2, 2016; however, Mr [redacted] did not attend these meetings and as such the documents were not signed A second set of documents was generated on May 1, and a new assumption closing meeting was scheduled for May 6, 2017, which again Mr [redacted] did not attendIt was at this time that Ditech found proof that Mr [redacted] was not residing at the subject property, instead Mr [redacted] had been residing within his primary property in the state of CaliforniaAccording to investor guidelines, occupancy is a requirement of the assumption process, as such it was learned that a critical investor requirement was not being met Once Ditech had learned about this issue an effort was made to reach out to Fannie Mae and request an exception to this guidelineHowever, Fannie Mae refused to honor the exception based on the potential risk associated with not following the guidelineAs such, Ditech has since been forced to deny the modification agreement per investor request and guidelinesAs long as the subject property is not considered Mr [redacted] 's primary residence no further loss mitigation assumption actions may be undertakenAdditionally, we are unable to comply with Mr [redacted] 's request that Ditech payoff a homeowners association lien
I am rejecting this response because I was never given the opportunity to reaffirm my loan on any account nor have I had any knowledge of the clauses of having my loan present on my credit reportBut for when green tree purchased my loan from Bank of America my loan it was transfer as a modification and in bankruptcy from thereonDuring this time , I had previously submitted an application for a modification with green treeThis new modloan was visible on my credit report and in bankruptcy during this transaction So, therefore, I find their statement ironic as my file promotes the opposite Lastly, Ditech has not addressed my second part of my concernIn the last sentence, as my payment history reflects late paymentsI am still without word to the adjustment on my fileEven through this loan will not show forth on my credit report due to the calamities The errors still do exist and are displayed as a blemish on my file with a DitechAs I have recently attempted to refinance with Ditech’s Refinance DepartmentI have spoken with Representative Eric who has unfortunately, upon review of my account payment history, disclosed I have been late in September, October and November of These posting are inaccurateBut more importantly, if the alleged late payments for the months in question were not met, I would not have ever been approved for my current modification in January of Simply, all four payments were made on timeI have submitted copies of my payment history which is visible and documented by Ditech website to address this issue on July 12, As this will establish my consistency and, my timely made payment to Ditech I would still need this area of my compliant investigated, in that I may obtain a better rate to move forward with Ditech's Refinance DivisionThank you in advance for addressing my concern Respectfully, [redacted] / [redacted] Style Definitions */
