Dear Ms. [redacted], This letter is in response to the complaint # [redacted] by [redacted]. By way of background, Defenders, Inc. DBA Protect Your Home is an Indiana corporation that specializes in selling residential alarm systems. We have been an ADT authorized dealer since 1998 that sells and installs ADT monitored security systems. Once the security system is installed, the contract is then purchased, billed, serviced and maintained by ADT. In summary, Ms. [redacted] states that the technician installed the panel in a location not compatible with the landline service. To avoid exposing the damage, she agreed to the higher monitoring rate for the Pulse service and cellular service. She was under the impression she had 30 days to cancel and also does not understand the contract. Ideally she would like to cancel with a full refund. Ms. [redacted] contacted Protect Your Home on February 4, 2017 in regards to an ADT monitored alarm system. She had received an advertisement quoting $27.99 for the monitoring rate, a free basic security package, and a $100 Visa gift card. She paid $105.93 for the installation and scheduled the installation for February 9, 2017 where she paid an additional $107 for equipment. The system was installed on February 9, 2017 where she agreed to a 36 month contract at $52.99 a month. This service has upgraded features that the $27.99 rate does not offer. This rate includes cellular uplink which allows a cellular connection to ADT via cell towers. It also includes Pulse Tier 1 which allows access to the alarm system though a smart phone, tablet, or computer. Lastly, it includes ADT’s limited extended warranty known as the quality service plan (QSP). The rate of $27.99 does not include any of these items and requires the alarm panel to be connected to a compatible active landline service. Upon signing the contract, Ms. [redacted] only had three business days to cancel without penalty. She called in February 14, 2017 to discuss cancelling, but she was offered a refund for the $107 and a downgrade to $27.99. She was advised that she still had the option to cancel, but she wanted to talk to her fiancé first. She did not cancel. It was not until February 24, 2017 when she called back to cancel. She was outside the cancellation at that time, so she was quoted the termination charges. This information was accurate. I called her to discuss her concerns and advised that the cancellation cannot be processed without a termination fee. I offered to schedule a downgrade and she accepted. As a courtesy, I added a second panel for free. This will allow her to have the $27.99 rate without having to expose the holes created during the initial installation. Ms. [redacted] was confused about which document was her contract. I helped her locate the contract and went over the terms with her. I apologize if she was inconvenienced during this process, but I appreciate the opportunity to address her concerns and help come to a resolution. In summary, Ms. [redacted] states she has not received a refund and she has not been contacted about the damages caused by the installation. Protect Your Home only collected one payment of $51.94 on December 19, 2016 through ACH. The payment came back with insufficient funds. Due to the NSF, a refund for $51.94 will not be processed. If Ms. [redacted] was charged for any monitoring fees, she will need to contact ADT at 1-800-369-0996 option 1. In regards to the damages, it is not standard process to repair holes after the installation was agreed upon. Ms. [redacted] contacted our company to install an alarm system, so we did. There was no mention of damages prior to this rebuttal. It is also not recorded on her cancellation form. If the technician did put this in writing, she will need to submit a copy of that. I attempted to reach out to Ms. [redacted] had to leave her a voicemail. Acknowledgement of Resolution: Our escalations repersnetative did speak to Mr. Reese on March 25th in regards to his complaint; he did express dissatisfaction on how his complete account was handle in regards to the account being sent to 3rd party collections without being called. He was also displeased that we never mailed the BOC letter to his old address vs the new address. Mr. Reese did advise that our installer was supposed to come to his residence back in January but missed the appointment time. Which we do not have records of at this time we just reflect in our notes that the customer rescheduled. We did inquire on the date he would like us to come out he opted not to continue with service. I did advise him that unfortunately he would be responsible for 75% of the contract on his old address in Colorado. He requested that we need to consider some his recent experience in to perspective when attempting hold him to the standard termination cost. Our escalations representative advised him I would be willing to lower the termination cost to 40%- $527.78 to prevent the complaint to going to social media and media. He advised he would submit the payment to internal collection team rather than the 3rd party collection company. We have confirmed that our 3rd party collection team has closed the account on their end on 03/25/2016 due to the complaint. Failing to comply within contract’s three day opt-out period, contract holds as irrevocable (w/limited relief) and enforceable. Client brings forth a “reasonableness/ fairness” argument in regards to the terms and conditions of the contract. This is an unfounded claim, as client was given privy to the terms and conditions (during initial sales call/post install) of the contract. Client will remain responsible for the duration of the 36 month contract. His claim via Revdex.com statement is simply preposterous, client voluntarily e-signed a contract, therefore, acknowledging “reasonable person” comprehension of the terms/conditions thereof. Client cannot justifiably argue “disability” or “fixed income” as he was aware of both his physical and financial status prior to entering into a legally binding contract. If client is experiencing system issues, then our Customer Care department (800 689 9554), is available to schedule an appointment to trouble shoot any issues. We have confirmed that client is in receipt of a copy of the contract and via credit card authorization agreed to any/all relevant charges. We have again verified that the contract is e-signed with your initials/signature. Client can contact our Customer Care Department (800 689 9554), and schedule a system/equipment downgrade. A downgrade of equipment will reduce the charges in equipment. DBA Protect Your Home is an Indiana corporation that specializes in selling residential alarm systems. We have been an ADT authorized dealer since 1998 that sells and installs ADT monitored security systems. Once the security system is installed, the contract is then purchased, billed, serviced and maintained by ADT. In some instances, the account his billed by Protect Your Home and then later purchased by ADT who then takes over the billing. In summary, Ms. [redacted] states that her monthly rate has not been corrected although she has a contract for $27.99. She would like the rate corrected and the charges reimbursed back to her for what she was overcharged. After looking into her account, I found that we were missing part of the amended contract. Without the full contract, ADT is unable to make an adjustment. I advised Ms. [redacted] and she agreed to sign a new one electronically. I notified the team responsible for creating and send the electronic contracts. I requested that is may take 48 hours to received. Once signed, ADT will receive a copy and will be able to adjust her bill and credit back to her any overpayments. I explained that it is a process, so she is welcome to call me anytime during this process. I apologize for any inconvenience this may have caused. Emily from HomeDefenders contacted me and she assured me the Visa card would be sent without any fee charged. I also noticed they removed this promotion from the web page, and she heard my admonition that no reference in the offer was made regarding fees.I also expressed concern regarding the pressure tactics and misrepresentation of the ADT policy regarding cancellation. We worked out a compromise that is satisfactory to both parties.Overall, the organization response was above and beyond what I expected after my initial experience, and I am glad to have signed on with them. I am grateful to the Indiana Revdex.com for facilitating this resolution.

I do not accept the response for two reasons, 1st, the company conntinues to claim that the letter I sent was not received. As you can see from the attachment it was delivered by the USPS on June 29th. 2nd, the response does not address the billing issue. I have been told by tI would be contacted about the final bill and have not been contacted. I suspect if I had not filed this complaint my letters & faxes would continue to "not be received" and the company would attempt tocollect fees beyond the end of the contract date. I willl not consider this matter closed until this issue has been fully addressed.

For your reference, details of the offer I reviewed appear below.I agreed to downgrade the service but I still did not get anything official, we talked 2 weeks ago and they said the billing department will contact me but they did not, I also need confirmation that the fake contract is not valid anymore and an apology about forging my signature on a contract I did not read and did not agree on, also you billing department charged me on previous address which was supposed to be cancelled and they said they will send me a refund for that by a cashier check 2 months ago and I did not get anything yet!

This letter is in response to the complaint # [redacted] by [redacted]. By way of background, Defenders, Inc. DBA Protect Your Home is an Indiana corporation that specializes in selling residential alarm systems. We have been an ADT authorized dealer since 1998 that sells and installs ADT monitored security systems. Once the security system is installed, the contract is then purchased, billed, serviced and maintained by ADT. [redacted] filed a complaint about receiving collections notices for previous home at 3224 Cork Bend Dr Indianapolis, OH 46239. He is requesting collection efforts to cease due to claiming he was not aware the contract would renew. Instructions to assist customers with moving their system are included with information provided at installation. Failure to follow these guidelines, to re-establish service with Protect Your Home at a new address, results in account holder being responsible for 75% of remaining agreement balance due to early termination. I show [redacted] contracted our customer service department in regards to upcoming move on December 10, 2015. [redacted] was transferred to our movers department to continue further with the process and he advised our representative that the new location he is moving to already has security. Our representative advised that if he did not proceed with the move he would be looking in termination fees of his 36 month agreement which I have included for your records. [redacted] advised our agent that he would check with his mother in law to see if she was wanting to have the service at her address. [redacted] contacted ADT Corp on December 10, 2015 due to moving to a different address effective December 18, 2015. As a result, we received notification the account holder did cancel within their 36 month term. When this occurs a balance of contract letter is sent. Our collections team did speak to [redacted] on January 12, 2016 in regards to his account and he was advised of the termination cost on the contract. [redacted] did offer to lower the termination cost on the call to 50% termination cost rather than the standard 75% that his contract states in the terms and conditions. However, he advised our agent he would need to speak to his spouse and call us back. We continued to contract [redacted] through the month of January and several messages were left with no response back. [redacted]’s account was then submitted to 3rd party collections on February 3, 2016. In effort to resolve the complaint our office is willing to lower the termination cost to 50% which is $915.35 and he would need to submit this payment to our 3rd party collections company. There has not been resolution. The December 1st appointment is in place because a November 11th appointment was again missed by Defenders. My security system is still malfunctioning. How can Defender wish to close the case when a technician has yet to even show up and fix the problem. An future appointment is not a solution to the problem it is the cause of the problem. They have repeatedly set appointments and have missed them. In my opinion the response is a joke and illustrates that they don't even care what the problem is and have no desire to fix it.[redacted]

We have been an ADT authorized dealer since 1998 that sells andinstalls ADT monitored security systems. Once the security system is installed,the contract is then purchased, billed, serviced and maintained by ADT. I have researched this account andfound that Mr. [redacted] has spoken with our customer loyalty agent and they haveagreed to a downgrade of the system which will allow Mr. [redacted] to be billedat the $44.99 monthly rate.
