The vendor sent an email on June 23, 2020 looking for people to be part of a Case Study Group for a Pilot Program before it was to be released to the public. I expressed interest, and the vendor responded by email on June 24 with full details about the 4 month "Total Transformation Program". We spoke on the phone on June 25 for 15 minutes to discuss whether or not I would be a good fit for the program. She accepted me as a Case Study participant, and we set up a full 1 hour follow-up call for June 27 to start the program, which would be billed as two payments of $147US each. She said I would receive online exercises each week to complete and we would have the next 1 hour follow-up call after about 2-3 weeks into the program. Calls would be scheduled at 3-week intervals, and exercises would move to group format online after 6 weeks. My credit card was billed on July 2 for $147US. I received the first 5 weeks of online exercises only, and did not hear from her to schedule the follow-up phone call at the 2-3 week mark. On August 1, the online exercises stopped. I texted the vendor that day to find out why the August 1 exercises didn't arrive, and asked when could we schedule our next call (which was now 2 weeks late). She didn't respond. My card was billed again on August 2 for $147US. I texted her again on August 2 with no response. She didn't respond until Tuesday, August 4 and said an edit needed to be done and to expect the exercises in a couple of days. No exercises arrived within a couple of days. I texted her a third time on August 7 and she responded with "enjoy this week" with no mention of when exercises would commence, and no comment about the next follow-up phone call. As of August 11, I have not heard from her and exercises have not commenced.

Desired Outcome

Refund I would like this matter resolved by a refund for the second instalment of $147US for lack of follow through of exercises and follow-up phone calls. I am no longer interested to continue as a Case Study participant in the Total Transformation Program.

Ms *** is right - we had trouble with the last week of the 6 week program. Because of covid our video editors were closed and we had to figure out a solution which took us a few weeks. Week 6 has been completed and has been up for three weeks now.

I believe Ms *** didn't realize that she had the ability and the link to make an appointment with Dawn at any time. Her calendar is on the website for anyone to make an appointment at any time.

Ms *** is not and has not been a Case Study Participant because that program is a 15 week program and she choose the 6 week program.

We deeply apologize for the delay in the edits of week 6 due to Covid but we did get up fairly quickly considering the circumstances.

Dawn is incredibly busy and usually responds to her numerous emails and texts two or three times a week. We apologize again for not responding to her text immediately.

When Dawn said enjoy this week, it was because week 6 was up for Ms *** to complete.

We believe a refund of half of a deeply discounted program where the last week was delayed due to Covid is not fair or ethical.

Ms *** has received all the weeks of the program.

In addition she has already requested a chargeback and received the amount back on August 18th.

She also agreed to a terms and conditions which clearly state no refunds.

Thank you for finally responding.

I was not aware that I was able to book a meeting with her at any time. A coach who does not check in with a client is not a coach with whom I wish to work. The program was not deeply discounted as it was a pilot program. I was not aware that the video editor's office was closed. I was not aware that the statement of "enjoy your week" implied that the week's lesson was ready. I was also not made aware of terms and conditions that stated no refunds - that's news to me. Had Ms. M. taken the time to explain these things up front, we would have been having quite a different discussion.

Communication from Ms. M. was poor, limited, and unclear.

Ms. M. is correct on one point - I did request a chargeback as I was not receiving any response from her. Rather than continue on this negative path, and as I have received the chargeback from a person who did choose to listen and respond, I wish to complete this process and move onward.
