I truly am sorry that this situation has came to where it is at, I am a Licensed Washington State Patrol Towing Company, I am always kept up to date with the laws and fees that are to be followed, we are inspected ( trucks and paperwork) yearly by the Washington State PatrolI gave the consumer all the info that is required by the Washington State PatrolI also went above what is required to help the consumer due to the fact of her selling the vehicle and not doing a report of sale to get the vehicle out of her name, I tried to find any loop hole that I could to help her, but unfortunately there wasn't anything that could be doneI followed the laws as required, and there's nothing I can do nowI told the consumer that she didn't pay the whole bill and that there were storage fees and tax fees that still needed to be paid, she informed me that she was not going to pay anything else, I tried to explain to her what would happen if those fees weren't paid and she didn't want to hear of it to the point that she informed me to take her to court for itI, again, apologize but I can not waive any fees once the vehicle goes thru the auction and is submitted to collectionsOne last note, the auctions are a public open bid auction, I have witness's to validate the motorhome was sold for $I have copies of every document with one being certified with a signature from the consumer that was sent to advising her what needed to be doneSo, everything that was done on my end was followed by the law

This is regards to case # [redacted]Davis Towing is licensed through the WSP and is given very clear laws to abide  by. By law when a vehicle is impounded, with in the first 24 business hours we are to notify the Registered and Legal Owners of that vehicle, such info is provided to us from the...

DOL. if that such vehicle is not redeemed after 120 hours form the time of impoundment it will be declared an abandoned vehicle and will be sold at an auction to the highest bidder. RCW 46.55  After that 120 hours that said vehicle is not redeemed we file an abandoned vehicle report stating that after 15 days from the date on that notice that vehicle will be sold at an auction. if the bid amount is not enough to cover the towing and storage charges and a seller's report was not filed (prior to the impound date) the registered owner will be held liable for the deficiency. RCW 46.55.140  Also failure to redeem an abandoned vehicle constitutes the traffic infraction of " littering- abandoned vehicle." Penalties for this infraction may include, but not be limited to, a $250.00- fine which can not be reduced, suspension of all driving privileges, and other penalties as may be imposed at court. RCW 46.20.289; 46.63.110(2) The consumer was notified with a 24 hr notice mailed out the 8th day of September, 2015. After the 120 hours of the vehicle not being redeemed we are required to send out an abandoned vehicle report that is mailed certified with the recipients signature. Those documents were mailed out the 14th of September 2015, and was signed by the consumer the 23rd day of 2015. ( I have all the documents and proof that this was all mailed and received by the consumer.I, [redacted], went above what is required of me to do to help the consumer, as far as contacting the WSP Trooper of Towing to help out this consumer, unfortunately there wasn't much that could be done since the consumer did not file a report of sale before this impound happened. The 21st of September, 2015 Davis Towing Received a check from the consumer in the amount of $582.00. I called the consumer and advised her that this is only for the tow bill that the tax and storage needed to be paid. She proceeds to tell me to sell it at the auction or keep it, that shes not paying anymore money for it. I advised her thats not really how this works. If the whole bill is not paid for and it doesn't get redeemed that it will go to auction but if it goes to the auction the storage continues on. The consumer said that I could take her to court for the rest then. I have a photocopy the check with the date to prove when and the amount paid as well.The vehicle was sold at an auction on the 5th of November, 2015 in the amount of $10.00 ( yes its low but the was the highest bidding price, which I can provide that paperwork to prove that too.) The complete tow bill with only 20 days of storage versus the actual 60 plus days it was in our impound yard breakdown is  2 hrs at $291.00 when what this consumer doesn't know that it actually took three hours but we felt bad for the people and were being nice and giving them a little help.so, 2 hrs at $291.00 = $58220 days of storage (instead of 60+) at $67.50=$1350.00the vehicle sold for $10.00                                                                                           so the remaining balance after I took off the $582 paid by the consumer and the $10.00 that it was sold for leaves a remaining balance of $1340.00 I feel as this consumer is also a local business person, that she her self would not be told what they are going to charge when they preform a service from their company, as I am sure that she does as we do, the rates are set for everyone, nor do I feel that this is very fair of her to take this action against Davis Towing when she was given numerous notices and phone calls, she said to take her to court for the remaining amount, which I am not but whats fair is fair those are the fees owed and they need to be paid. I never once made a promise to her saying that all she had to pay was $582.00 and no tax or storage fees. I am not wiping out the storage bill now she had more than enough time to work this out with me before it went to collections, maybe next time don't tell someone what your going to to pay them for a service that's set by them and if they don't like it to take you to court and don't punish someone for your mistake of not transferring the title.

The people are rude and mean. The tow drivers are nice though but having one of the people in the office being rude to me say he doesn't want my totaled car in his wrecking yard. No payment plan wants full money upfront and $45 a day storage fee is absurd.

Review: In June I sold my motor home. I did not file to have the title taken out of my name and neither did the buyer. In August or September the buyer totaled the motor home . I was notified by mail September 25 I owed the towing bill of $582.00 which I paid the following week October 2, 2015.

I was told they would waive the storage bill if I paid the towing bill. Three days later I received a phone call from Shelly that she forgot to include $126.00 for some other charge . I refused to pay any more. I did not receive a bill or hear anymore from them .

September 27 , I filled out the paperwork on line with the department of licensing that I sold the motorhome.

in December I received a call from Bonded Adjustment company that I owed 1,000 dollars for storage. I have not received a bill from them either.

I called Davis Towing and talked to Shelly . she said she did not send any bills because she decided I wouldn't pay them anyway.

I believe Davis sold the motorhome at auction. I do not know if they applied the funds to the storage bill or not. I have not received any paperwork from Davis or Bonded Adjustment ,

I feel this is unfair business practices . I have excellent credit rating and I hate to have it ruined.
