DPS installed a gunite pool & hot tub when filled we discovered the hot tub has a plumbing leak and they will not fix it unless we split cost!!!
DPS installed a 20x36 gunite pool and 9x9 hot tub the hot tub was filled with water on May 18 2018 at which time my husband discovered a air and water leak around the hot tub. On June 1 2018 we contacted *** and came over to run a test and we was determined to be a leak , he then contacted American Leak Detection they came out and found where the leak was around the hot tub. We contacted *** and he came over and told us it was not his responsibility to fix the leak that because we had poured concrete around it it was our fault. We never touched the plumbing and it was back filled by DPS before concrete was poured. We have pictures of the whole project that show he never did a pressure test on the plumbing that should have done several times. The date of our contract is 6-28-17 with no completion date as of yet there is a warranty on the pool and hot tub construction that states all defect will be remedied at no cost to owner!! But he refuses to fix our leak.
I would like our hot tub fixed
During the construction of this project we have been verbally abused, cursed out, and had a substantial payment check cancelled due to no fault of our company. This has created an intensely hostile environment for us to work in. We do not dispute the fact that there is a leak in one of the plumbing lines. However there is a question of culpability. We spent significant additional funds to have an outside company locate the leak. There was an extensive amount of work done by other contractors in the location where the leak was determined. Contrary to the customer's claim of having "pictures of the whole project that show he never did a pressure test on the plumbing" we did in fact pressure test the plumbing twice - once post install (of the plumbing) in the fall of 2017 and again in the spring of 2018. When we last met with the customer the topic was to be as to the approach to be taken to repair. The statement was made by our company representative that, until it was proven that it was in fact the fault of our workmanship, the cost of repair should not fall 100% on us. Before any proposition could be made toward resolution the customer made the statement that "they'll see you in court". Due to the previously mentioned hostile environment we at that point left the site.
We are more than willing to repair the leak. We will not remove the concrete or replace the concrete at the point of the leak as that is/was not a part of our scope of work. If it is found that the plumbing was installed incorrectly we will repair at no cost. If it is found that there was damage to the piping due to the other work done around the pool we expect to be compensated for all expenses involved.
With regard to references to our contract, specifically the warranty, it clearly states that "Use of the pool prior to completion shall render the warranty void. No claim may be filed under this warranty and no obligations to make adjustement thereunder will occur until the full indebtedness of the Owner to
Contractor is paid." This customer continues to use the pool and has yet to pay their final balance.
I was very disappointed to come home today, after my pool closing, to find my patio furniture shoved out of the way and not returned to all 8 pieces' correct placement. Also, the sign on my gate warns the entrants that there are dogs in the yard. Perhaps you could CLOSE the gate and make sure it is latched when you leave? Daudelin proves to me that they provide minimal service without respect to the customers' property and pets.
Our apologies for leaving the gate open ***. And if there is a 'correct' placement for the patio furniture it was not communicated to us at the time of scheduling. We do need to be able to work around the pool area to effectively close the pool and if the patio furniture was blocking the access then yes, we will move it out of the way.
Perhaps a simple phone call to our office would have been sufficient for us to remind our employees to shut the gate.
