I bid on several items on liveauctioneers.com that were listed by Dalshire International. Upon completion of the auction, I was sent an invoice for the won items. 2-3 days after payment was accepted I received an email from Dalshire international stating that an item I had won cant be fulfilled because "we ran out of stock". I was noticed that they would replace the item with another. I found this to be suspicious because auction houses post items for auctions that they have on hand. I immediately asked for a full refund for the whole auction lot and not the ship any of the items. 3 days later I received a call from John H telling me that I have won amazing items and that they could replace that item with another, Once again I said no because I no longer trust any of the items and that all credibility for the items and the auction house has been lost. I was told that he will speak with his boss about the refund. 5 days go by, several emails go unanswered, customer service sent me an email saying "sorry but you'll have to talk to my boss (***) I just work for him. Youll have to email him" Some customer service. I never asked for the 1 item to be refunded, I asked for the whole auction to be refunded. They are refusing to refund the items, stating that there terms and conditions say they don't have to. But the conditions don't state you're bidding on items that might not exist. I have notified The fraud department and they have opened a case.

Refund I would like to have the auction refunded. Human errors happen, but that's why you have to restore trust with the customer not to do as you want. The fraud department at the bank has asked for the emails and the phone call which was recorded, all of which will be emailed
The Terms and Conditions of the sale dictate how matters like this are to be resolved. Per the Terms and Conditions of the sale all winning bids are final sales. If a bidder requests a cancellation it is in the sole discretion of the auction house whether or not to cancel the winning bid. Per the Terms and Conditions of sale, if the winning bid or in this case winning bids are cancelled the winning bidder is responsible for the buyers premium and re-stocking fees. In this case the bidder was refunded all of his money less the buyers premium and re-stocking fees, which is clearly defined in the Terms and Conditions of the sale. The bidder agrees to the Terms and Conditions of sale when they register for the auction and place a bid. It is true that one of the many items won by this bidder was out of stock which the bidder was notified promptly and offered a substitution. The bidder refused refused the substitution and was promptly refunded the amount of the winning bid as well as the buyers premium.
