I personally communicated with this member and I am familiar with his complaint Music volume is an important factor in customer satisfaction in the gym business, but of course there is never a volume level that pleases all members We place our highest priority on safety, and therefore do not exceed decibels, but beyond that we also are sensitive to the wishes of our customers Upon hearing this members concerns we checked the decibel levels to confirm that the volume level was below decibels and we had our staff further reduce the volume level in an effort to satisfy this members concerns Unfortunately we were not successful at finding a happy medium Our membership agreement is among the most flexible gym contracts in the industry, and we do not require members to commit to any long-term relationship This members agreement is month-to-month, and provides him with the option to cancel at any time and for any reason He chose to cancel due to his displeasure with music volume and we complied with his request and stopped all future billing The membership agreement (copy attached) expressly states that the member is not entitled to any refund of his enrollment fee, monthly fee or annual fees Section addresses the annual fee specifically.We regret that we were not able to find a workable solution for this members concerns
