I requested a loan from this mortgage company to purchase a home. I provided all the documentation they asked for including W2, tax returns for 2015, 2016. I explained my marital situation in complete detail to them in my very first conversation with their loan officer, Christopher H. In a few days, I also sent the same via a letter per their ask. I also told them explicitly via email that I will not be able to provide divorce settlement documentation. For which, the loan officer explicitly stated that divorce settlement documentation will not be needed and that I will need to provide a letter written by me regarding any alimony or child support that is to be incurred of me. Loan officer confirmed that I was good for the loan, clearly stated the rate and asked that I pay of my car which I did. Mortgage company sent a rate lock document which I signed as well. Only after loan officer's confirmation, I paid for property appraisal.
Today, this company sent me an email stating if I do not provide divorce settlement or equivalent documentation, they will increase the rate for the loan.
This is wholly unfair and just plain wrong. They are taking advantage of a vulnerable situation. I stated very clearly my situation and my limitations from the beginning. They misled me throughout that everything was going well and they know very clearly I am up against December 19th as the Closing date which was the agreed upon date by all parties, including this mortgage company. They chose today to tell me about documents that they know I cannot produce and are saying I now need to pay a much higher rate to get the same loan.
