Ms. [redacted] hired our firm to file a Chapter 13 bankruptcy for her. We did so on July 10, 2014. Her case was not a typical case but was proceeding. In June 2015 a motion to dismiss her case was filed due to missed payments and the failure to provide copies of her 2014 tax returns. A stipulation was negotiated and Ms. [redacted] was required to provide her tax returns to our office no later than August 28, 2015 and she was to make her payments on time going forward. She made her payments but did not provide her tax returns to our office. Her case was dismissed on September 15, 2015. Even though we sent letters and emails regarding the deadline to provide her tax returns, we did not hear from Ms. [redacted] until October 1, 2015. She provided that her case should not be dismissed but still did not have her tax returns. Once a case is dismissed, it is extremely difficult to reinstate and it has to be done right away. We didn't get Ms. [redacted]'s taxes until after November 1 and there is no way to reinstate her case now. This has been explained to her on various occasions but it is not the answer she wants to hear. I do apologize for having her case get dismissed but the Ms. [redacted] did not provide the information required in order to continue her case. She has been in Chapter 13 previously and knows the requirements of Chapter 13. As for refunding her money, the money she paid into the Chapter 13 was dispersed to creditors, mainly the IRS, and cannot be returned. Our attorney fees were approved by the Bankruptcy Court and paid through her plan as well. If I can be of any further assistance, please do not hesitate to contact my office. Thank you.
