area and clearly show that the 2XL shirts are priced at $12.99. In addition, the second sign clearly states "or priced as marked" on it. As you can see from the price tag photographs also enclosed, the tags are marked differently on the S-XL sizes than on the 2XL size. We also have other shirts which are not included in this special pricing that is why the sign says the t-shirts are priced as marked.As to an employee telling the customer that the 2XL were included in the 2 for $20 pricing, as the customer gave no employee name, I cannot speak with that person to find out whether this statement is accurate. I can state that this is a question we get often, and all our employees know to tell customers that the shirts are priced as marked on the price tag for the shirt.We do not "Bait and switch". Our signs and price tags clearly show our prices for the merchandise. I am not sure how our signage could be any clearer. It already states the prices on the 2XL shirts are a different price.The customer even states in their complaint that they saw the signage that showed the 2XL pricing was $12.99.Regarding the last portion of the complaint, that although not illegal, charging more seems discriminatory against people of size, we charge more for the larger shirts because we are charged more for them. Generally speaking, retailers do not charge the same price for merchandise that they pay different prices for.In conclusion, we do not feel we are in the wrong in this situation.
