I am rejecting this response because: The premise of this response is based on a fallacy, and your words are intentionally deceptively phrased, accusatory, and attempt to deflect culpabilityFirst I need to address your deceptive language: It is not, and has never been the case that the repairs you performed 'did not *resolve*' the noise issuesYour repairs, in fact, *caused* said noise issue with the shocksI brought my car in for the transmission specificallyThe noise, as I stated, was distinct grinding coming from the center of the car, starting mere minutes before I called your shop, caused directly and solely by the transmissionThe shocks were entirely silent at that time, as they have been for the last year since they were replacedI drive my car every day and know what sounds it makesThey NOW make an altogether different sound in a different location of the vehicle and had not made that sound *before* the repairs were done to itIt literally started --The Second-- I started driving my car out of your parking lot I do not, as I clearly stated, deny that a clutch was needed as wellThat is fairly standard practice and I had no problem paying for itI brought up the clutch to display that I have no problem paying for work neededI had no problem paying for the radiator leak either, even though it was entirely unrelated to the reason I brought the car inI brought both of these items up to show my good faith in paying for what is neededMy brakes also squeakDid I accuse your shop of damaging them? [redacted] brought her car ([redacted] with 160,874 miles) to us to fix her transmission and we did have to replace the clutch as part of the job. This is not uncommon with cars with these many miles. Unlike general repair shops, we only do transmission and transmission-related services. As such, we did not focus on any other issues or noises associated with the car outside of the scope of the transmission. As she states, “I brought my car in to Cottman Transmission to have the transmission replaced as it was making noise and grinding.” Our concern was fixing the transmission-related noises. We stand behind our work and [redacted] chose the repair options with the following warranties that we will happily honor if any issues arise: Used transmission – 90 day or 3,000 mile; Clutch Assembly – 1 year or 12,000 miles. I am rejecting this response because: I was told by Officer [redacted] with the DMV that there was a lien on my car and that I some how have a bill for 598.00. I have never agreed or signed anything with Cottmans Transmission . I was never told of a 200.00 discount .. When I went to check on my car I was told by Susan [redacted] that my car was indeed sold . It was removed from the lot and did not return until I got Officer [redacted] involved. I was told that the diagnostic and towing to their facility would be free. Susan had agreed that she would not do anything to my car until I either paid half or all the balance for the transmission to be fixed . I have tried on several occasion to have my car towed back to my address and was told several times by Susan [redacted] that my car would be perfectly safe. I have MS and I am not able to go up there to check on my car every week due to my illness. I have already paid Cottmans Transmission 100.00 in cash that was suppose to go towards my Transmission . At this point my attorney is now involved and has taken over this case . There are several others who have been through the same thing with Cottmans and are ready to testify against them of this type of actions to consumers. I did not abandoned my car nor did I give Cottmans permission to sell my car.

WITH THAT BEING SAID A FRIEND WILL SAY WHAT YOU WANT THEM TO. THE TOW BILL WAS $60.00 AND SHE KNEW THAT SHE WOULD HAVE TO PAY THAT IF SHE CHOSE NOT TO HAVE THE WORK DONE AT OUR SHOP,WE ONLY OFFER FREE TOWING WITH ANY MAJOR REPAIR. I AM NOT WILLING TO REFUND MS. T & M Fence installed a 150' cedar 6' in height privacy fence in my back yard. This is a brand new home. The crew who installed the fence post did not install the fence post properly. On one side of my property the fence post were installed 15" from the property line between my property line and the home next door. When getting the appraisal I specifically stated I wanted the fence in that area installed as close to the property line as possible and Greg who is a T & M Fence supervisor giving me the quote recommended the fence be installed 2" from property line which I asked it be installed 3" from the property line. The crew who installed the post sat on my brand new home window sills smoking and leaving cups on my window sills. they threw cigarette butts in my yard. They damaged my mailbox. Poured oil and gas in my yard killing a large area of sod in the front of my home. I phoned the office to complain about this and request a different crew finish the job. Days went by. Repeatedly had to phone the office to simple get the work completed. After several days of calling the office repeatedly a crew and the supervisor Greg shows up in a rain storm to complete the fence. After a bout 1 hour I ask Greg if they could finish the job another day when it wasn't raining which that particular day it was a huge downpour and lightening and the crew were out there in the stormy weather using power saws and I was concerned of their safety . They left and Greg stated he would be back to complete the job as soon as the weather cleared which I agreed . Days went by and the weather cleared but no one here to complete the fence. Repeatedly phoned the office but seem to get the run around as to when the job would be completed. I phoned the office at least 3 times a day to get information as to when the job would be completed but had no answer just excuses even at one point I was told Greg was at a doctor appointment and would nit be able to complete the fence until the following week and this was on a Thursday. Monday the following week I phoned the office again to complete the fence and was told it would be completed the following day. The following day Greg the supervisor showed up to complete the fence alone . Greg spent several hours completing the fence . The fence is extremely flimsy in area's. There are saw marks on area's and area's are not nailed. The entire fence does not appear to be a $2700.00 professional fence installation. I cannot recommend T & M Fence. The entire experience was extremely unprofessional and I made this comment in an email I sent to the office and made this comment to the owner himself over the telephone which no one seemed to be concerned . I felt extremely unappreciated as a customer. Most important I was advised after the fence installation T & M Fence does not offer any warranty on their work. I am having to have another fence company repair the poor work T & M Fence performed so that the fence doesn't fall down in a storm. Extremely unprofessional! Not asking for anything from T & M Fence. Honestly do not want these people back on my property .

installer quoted the [redacted]'s over a one thousand ($1000.00) dollar price for the digging of the pool site. That quote was based on a 24' pool, not a 27' pool. The digging charge is $24.00 per inch upto 36" on a 24' pool. Mr. B[redacted] has indicated that he informed the [redacted]'s that the dig would be over three feet. He also discussed the fact that a retaining wall "may" be needed. His plan was to taper the dig to try avoiding the wall. This was also discussed.I am curious as to why the [redacted]'s are trying to relate the fact that they contracted the excavator with holding Pool City responsible for the outcome? In their complaint they acknowledge that their own excavator informed them of the depth of the cut prior to digging. Did he indicate the need for a retaining wall? I understand that he cut the site with a 90 degree cut, no tapering. This would absolutely require a retaining wall to hold back the earth. I understand the frustration that the [redacted]'s are dealing with. Pool City has no control over the contour of our customer's property. I understand that they were not happy with the price that Mr. B[redacted] quoted. They were perfectly within their right to choose another option. When homeowner's choose to bring in outside contractors to perform work prior to us building the pool, we would expect that the individual excavator would discuss the scope of their work with the homeowner. I would think that they would understand what the finish product would look like when they had completed their work. If the need for a retaining wall was imminent, I would think that was the responsibility of the excavator to discuss with the homeowner. Pool City has no affiliation with this individual.It is for this reason that we must regretfully decline accepting the terms of their settlement request.Sincerely,Mark *. It was determined that the pump needed replaced and was ordered the same day. The pump was received on...

   This customer came in for a free transmission evaluation we tried to move the car into our facility for the free check and the car shut off, and would not start back. There was no charge for this free service. We told her we...

would do a transmission check. Her problem was not the transmission. We are a transmission repair facility not a general repair shop. She was referred by a general repair shop because they could not determine what was wrong with the car. We simply gave her our suspicions. The engine was spinning free as if it had no compression this is usually a timing issue.    
  We conveyed this information to the customer. We then explained that her problems were larger than we were equipped to handled and suggested she find another repair shop. We also told her that if she had broken a timing set with 234879 miles on her engine it would most likely need replaced. We never performed or charged her to perform a diagnostic.
 
     In close she came to us for a free service that we were unable to perform. Due to the nature of her failure. The customer expressed that she was upset that we would not diagnose her engine problem at no charge. The evaluation we perform at no charge requires her engine to be operational so that we may perform a road test. Since her engine was not operational no Diagnostics were performed. We make no claim or guarantee to perform a free engine diagnostics. so at this time we are not inclined to pay her $85.00 for letting us attempt a free service

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
It is surprising to see that Mr. B[redacted] had time to respond in a timely manner, as he never had time for us prior to the submission of this complaint.  I understand how this issue is difficult to comprehend due to the extreme challenges this company faces regarding communication.  Unfortunately, the facts stated by Mr. B[redacted] are incorrect.  A quote was never provided for digging, nor was the need for a retaining wall discussed.   I would like to review a copy of the prepared quote stating the price and the possible need, including cost, of the retaining wall, as one was never provided.                Pool City is the responsible party because they sent the installer who marked where to dig for the pool, incorrectly estimated the dig, and approved the dig by our excavator prior to it taking place, but after being told of the depth and angle required. The land was tapered on sides where room allowed; however, the one side made tapering impossible.  This was all made very clear as I spoke to Mr. B[redacted] before any excavation took place.  He said to dig it, and that it would not be a problem as long as the bottom of the hole was level. I can submit phone records indicating that this communication took place prior to any excavation work taking place. The excavator dug according to the Pool City installer's markings, making Pool City the responsible party.                 I find it impossible to believe that Pool City can understand our frustration since they failed keep appointments or even call to cancel those missed appointments.  It is silly to state that you have no control over the slope of the property, as I would never expect that.  What I did expect, and request during purchase, was that you come and see what needs to be done and what size pool would fit.  I was not unhappy with the provided quote, as one was never written.  The Pool City paperwork I did receive clearly states that jobs over 30 inches are by bid, and we would have to pay the contractor directly.  That is what was done.  I understand that Pool City may have difficulty taking responsibility for their incompetence,  and I hope they resolve their communication issues.  In the meantime, I will be sharing my negative experience via social media and by word of mouth.  I do not want any of my friends or relatives to endure such a terrible experience.
