Management at this location forced us to move early for renovations and then charged us to pay for renovations. We were charged $1200 to replace bath tubs. When I questioned this I was told it was because “the bath tubs were so dirty they were damaged. We also accrued other charges that seem wildly excessive. I believe we are being taken advantage of in the situation so the apartment complex can recoup some of the renovation costs. During our time at the apartment complex we have dealt with constant construction, loss of amenities, and fear of break-ins (email sent from apartment complex warned of this, which I believe was due to gates being constantly open). The total for our move out bill was over $2400. We are in a situation where it’s either pay what they want or not be able to move in somewhere else. We need help resolving this matter.

To Whom It May Concern:I am in receipt of the complaint dated February 28th, received in my office on Thursday, March 8th. In response to this complaint, I direct you to the following paragraphs in the Texas Apartment Association lease contract:
• Paragraph 38-Damages and Reimbursement: You must thoroughly clean the apartment. If you don't clean adequately, you'll be liable for reasonable cleaning charges.• Paragraph 40- Security Deposit Deductions and Other Charges: You'll be liable for the following charges, including repairs or damages, replacement cost of our property that was in or attached to the apartment.
Any charges passed on to any of our residents are thoroughly documented with photograph evidence which we would be happy to provide to the customer. We are also able to provide invoices from our vendors to coincide with the charges assessed on Mr. account.
These charges have been reviewed, and none will be waived at this time.

I am rejecting this response because:
I still believe replacing the bathtubs was unnecessary and we are being made to cover the cost of the renovations.

After leasing an apartment with Avington Park at Fossil Creek in Fort Worth,TX, I discovered water damage and active mold in the dwelling upon move in date. After bringing it to the attention of the property management team and maintenance staff, I was initially reassured the proper steps would be taken to restore the damaged areas, as they were unaware of the issue. After three scheduled attempts for maintenance, of which all three resulted in no-shows from the maintenance crew, I started making weekly to biweekly requests with the property management / leasing team. By the fourth week, members of maintenance showed up to complete about a quarter of the request for repairs and never returned. All members who performed the maintenance verbally acknowledged the existence of water damage being in the apartment pre move in and all concurred that the mold must be addressed, however no one has fixed it. I continued to make requests, both verbal and through their online portal, and my bi weekly requests to have the work completed have been ignored. it is now week 7 and I continue to live with water damage and mold in my dwelling, while the team at Avington park at fossil creek consistently ignores my pleas.
