I would like to give an accurate account of what transpired between my business and a specific customer. He came to my business and requested a 45ft Boom lift. We had asked if he would like someone to go over the basic operations of the Boom Lift with him, and he shrugged and said “no.” He was not...
interested in learning how to properly operate the machine. At no point in time did he request an off-road/4x4 machine. Luckily, the 45’ Boom Lift that he had requested was, in fact, for rough terrain. We delivered the machine, and a few hours later we received a call from him saying that he was stuck in the air and could not get down. We sent our field technician to assist him, and upon our arrival, my technician discovered that the customer was at too much of slant. This caused the machine to cease moving. The customer insists that it was only a 4% grade, but this was simply not the case. My technician took some photographs on his personal phone showing that part of the machine was not on “the county road.” The alarm was buzzing, thus indicating that the machine was not level enough to operate, and was, in fact, in a hazardous position. We have since rented this machine out several times, and no other customers lodged any complaints or reported any issues whatsoever. In the end, there was absolutely nothing wrong with the machine. The customer did not know how to properly operate it. In the hopes of providing excellent customer service, we even went so far as to not charge him for the service call we made, which was more than fair considering the issue was a user/operator error. I was prepared to negotiate with the customer on the rental agreement & price, but he was completely unwilling to take any responsibility for the incident and was convinced that the issue was with our machine—something that our mechanics have all ruled out.
Review: I rented a dump truck from this business on 7/13/2015 and returned it on 7/15/2015. At the time of the return I was charged for the diesel fuel that the vehicle used. No one had ever told me that I had to pay for the fuel used. The rental agreement does not say anything about me having to pay for the fuel used. There are no signs at the facility that states that I am required to bring it back full or pay for the fuel used. I paid $.30 per mile which was more than enough to cover the cost of fuel used. This business used these deceptive practices to raise my rental rate above what competitors would have charged me for this 2 day rental. The result was a charge $97.50 higher than I anticipated. It places competitors at an unfair disadvantage in violation of fair practice laws.
