This letter comes in response to complaint # [redacted] dated 10/21/concerning damages to a driveway at [redacted] *** This letter states that I entered the property with a large excavator and that is not trueThe job was done with a rubber tire backhoe that in no way would cause the damage I am accused ofHe also states I spoke with someone on the phoneI have never had a conversation about this damageI am interested in knowing why this complaint came one year after the septic system was installed by another contractor that would have had a large equipment running over the drivewayIf I can be of further assistance feel free to contact me

To whom it may concern at Revdex.com…This notification is in regards to the complaint submitted on 10/9/against Clement *** ExcavatingComplaint # ***We called your office and spoke with *** on November 20th asking why we were not able to respond to the letter or response given by Clement *** on Nov 1st when we were should have had days to respondWe did not get notification of his response until November 17th I have enclosed a copy of the screen shot from my email showing the date we were notified of his responseAfter entering the site found the case closed and unable to respond to his statement*** informed me to write in the response and you would enter it into the systemSo please find the response below with accurate dates and facts to Clement ***s statement that will support the damaged he caused to our drivewayWe have also enclosed picturesFirst… Clement *** was going to be the contractor to install the systemHe was the one who came onto our property by way of our drive way with a heavy equipment excavator and the tracks in the pictures will not only show how big and wide and heavy the machine used was it shows the type of machine used to dig this pilot holeNow if Mr*** wants to contend that these tracks leading to and from the pilot hole he dug in my yard on October were from a backhoe with rubber wheels that’s fine but either way it was his big heavy equipmentAgain, I believe the pictures show otherwiseThe opening to our driveway at the fence is 11ft - inch wide and as you will see in the pictures the tracks from the machine is just about thatHe barely made it through the opening because the machine he used was so big to dig a small pilot holeThe deep wide impressions left in our yard from his machine match up with the damage to our drivewaySecond…Clement *** contends our septic was done by another contractor a year prior to me filing thisThat’s not true because our septic was not done until the end of June and the beginning of July As you know there is a process that must happen here in Rhode IslandWhen you want to have a septic done you must have a pilot hole dug to determine what kind of system is needed for your homeThat is what Clement *** did on October Then the engineer had to draw up a planThis takes time to get it all approved by DEMDate of approval was November Once you have the draft, which then must be sent to you approved, you can then start submitting this to contractors to bid on the jobThis is where Clement *** lost the jobWe waited and waited and called him asking for the costThen when he final called and we spoke over the phone that’s when he told me personally… quote : we will have to do something about your driveway when this is done” No he did not give us a written contractHe couldn’t even give me the final number because he contended the cost for pumping out the old septic and doing the electric work for the pump attached to our new system may vary and would have to wait till the job was done before I get the bill for itHe never submitted a contract in writing evenThis did not sit well with us and Rhode Island housing authority who was approving our loanThey wanted a written quote and a final numberThis is when we decided to go with another contractor who not only gave us a written quote for everything to be done he came by in person to give us the quote and to go over the detailsWe were not approved for the work to be done by RI housing Authority until April Clement *** never followed up with the quote and further looking into doing the job so again we were left to look elsewhereThird… One of the main reasons we never pursued this right from the beginning is because Clement *** was supposed to be the contractor doing the job and that’s why he was the one digging the pilot holeSo once we got his call and decided that he was not going to be the contractor doing the job I stated taking pictures of the damage and tracks in our yard when the snow melted and you could see the yard and driveway on March The tracks were frozen into the ground and the deep groves from his machine leading to and from the pilot hole he had dugWhen the contractor we decided to go with came over to the house for us to finalize the contract and saw the damage we asked him if he was going to be using heavy equipment to do the septic system and dig up the yard and he said no wayAlthough he said you never knowOn that note I wanted to wait till the job was complete before making accusations of this kind toward Clement ***The fact is our contractor only used a small Bobcat to do the whole jobHe was very meticulous about his work and did a wonderful jobLast of all… we now had to get a quote on what need to be done to repair the drivewayWe thought maybe they could just recoat it but after the paving companies came they all told us it had to be torn up and replaced due to the amount of damage that had incurred to the drivewayWhen we had that we sent letters out to Clement *** at ** *** *** *** ** and got no responseWe then sent letters to his *** *** *** *** ** where his license is also listed and had the mail returnedWe have now reached out to Revdex.com to try and resolve thisWe will pursue legal action if needed but hope to resolve this here*** and *** *** ** *** *** *** ** *** Complaint #***Is already filed and this response needs to be added and sent to Mr ***My case should have not been closed without being able to respondWe were not given daysI cant add pictures here of anythingI would like a call or my response to be postedWe have certainly responded within days ... We have gone back out about 3 weeks ago and filled the area. I consider the issue to be resolved.

cause the damage I am accused of. He also states I spoke with someone on the phone. I have never had a conversation about this damage. I am interested in knowing why this complaint came one year after the septic system was installed by another contractor that would have had a large equipment running over the driveway.
