SEE ATTACHMENT.We have received your notification that a complaint has been filed against KESA by an injured employee (claimant) of a KESA member (employer).KESA's records show that the injury occurred on October 8, at 2:PMThe claimant reported to work the following day, October 9, She was seen by a physician on October 13, and was released to return to work effective October 17, 2016.The claimant provided an additional note from her physician's office dated November 3, 2016; however, KESA's adjuster confirmed with the physician's office that the claimant was not seen by the doctor on that date and that she was not excused from work beyond October 17, 2016.All medical bills related to this matter received by KESA to date have been paidBased on this timeline, and per the Kentucky Workers' Compensation Act (KRS Chapter 342), the claimant is not eligible to receive temporary total disability benefits.If the claimant believes this decision is in error, she may file a formal claim with the Kentucky Department of Workers' ClaimsHer file will be assigned to an administrative law judge for adjudication.Regards, [redacted] Chief Financial Officer & Treasurer
