When Mr*** brought in the light fixture to our shop, the first time he and one of our salesmen discussed how and to what size the glass should be cut, while they were looking
at the fixtureOur salesman measured for the glass while Mr*** watchedWe custom cut, polished, and double frosted the glass to agreed upon measurementsMr*** was called when the glass was ready and he picked up the glassIt is our policy to collect a 50% deposit to begin processing all custom cut orders, with the balance due upon completionMr*** gave us $at his first visit to our shopHe later had his client, Mr***, call us with his charge card number to pay the balance due so he so Mr*** could pick up the orderWhen Mr*** later came back in saying that the glass did not fit the fixture correctly, Mr*** again discussed what he wanted in size and fit with another salesman"Tight, end to end, with 1/6" clearance," per Mr***Our salesman explained to Mr*** that he needed to be sure this timeWe custom cut, polished, and double frosted the glassWe did not charge Mr*** (nor Mr***) for the recutsMr*** is correct in saying that our not charging for the recuts was a gesture of good will on our partWe have been in business for over years and pride ourselves in giving our customers what they request, custom cutting to our customer's specsMr*** talked with different salespersons here, on different occasions, and it is very unlikely that both salespersons got it wrongPerhaps through trial and error, Mr*** used the orders we cut for him to determine what he thought was a better fit for the glass, and then gave a different explanation to the other glass companyWe cut, polished, and double-frosted the glass to Mr*** specs, twiceWhen he picked up the order the first time, he left the original pieces at our shopWe discarded themThe second order is still at our shop if Mr*** wants themWe cut, polished, and frosted the glass to Mr***'s specs, TWICE, and do not feel we owe him a refundDo you?
