Denny *** (owner of Chinook Custom Vending) had business dealings with myself for the past 4 years with vending machines at the establishment where I worked. When my husband & I purchased the business, Chinook Vending kept their machines on site for 23 days in August 2019. Denny was aware of the change over & when payment was not issued for commission on the sales of his product, Denny stated that he was waiting until year end books to be completed before he could pay. Now, 6 months later, Chinook Vending still has not paid & has stated that as there was no signed contract, they will not be releasing the commissions they collected. Very dishonest & untrustworthy business dealings.
We just want people to be aware of this & to ensure they have everything in writing with this company & do not take his word.
is a national entity that Chinook Custom Vending had a vending agreement with since its establishment in Lethbridge. In August of 2019, this establishment was transferred into the private ownership of *** and her husband, now called ***. Upon this transaction, Chinook Custom Vending was informed that under the new ownership, a concession would be set-up within the vicinity in addition to the vending services that were being provided; three weeks into ownership, the concession was established, and Chinook Custom Vending was asked verbally on Wednesday, August 31 to remove their equipment by end of business on September 2, leaving only 48 hours’ notice to move these heavy pieces of machinery.
Chinook Custom Vending has been providing services to Southern Alberta for over 20 years and has over 450 pieces of equipment. These services are provided to clients in two forms; those who have vending contracts, in which the terms of these contracts contain clauses that dictate commission rates as well as contract termination standards, and those who do not have contracts and therefore are entitled to no commission. Chinook Custom Vending had a contract with the national company of ***, which upon sale of the franchise was terminated. The new owners of *** did not establish a new contract with Chinook Custom Vending to dictate terms of commission, but rather misleadingly used our services as a stop gap until they could independently provide food and beverage services to their clientele; therefore there are no commissions to be paid for the three week period that vending services were in place. When conversations were had with Mrs. regarding establishing commissions moving forward, it was under the pretense that Chinook Custom Vending would enter into contract with the new owners after close of year end, which for Chinook Custom Vending is September 1. If Mrs. would like Chinook Custom Vending to uphold its standard contractual obligation regarding commissions for this timeframe, we would respectfully ask that our termination standards of 30 days be upheld, and therefore seek losses and damages due to the 28 days of lost revenue associated with this transaction.
