I am responding to the complaint filed by [redacted] in regards to the sale of her home located at [redacted] , IN After careful review of the transaction, I am confident that our company and our agent [redacted] acted ethically and professionally; put ***'s interest as priority; never provided information to ***; did not disclose confidential information and all offers were presented to ***Below is an outline of the pertinent facts in the transactionWe would be willing to provide supporting documentation if requestedOctober 4th, [redacted] entered into a listing contract with CENTURY ScheetzOur agent, [redacted] ***, provided a comparative market analysis on the property showing what homes in the neighborhood were selling for and recommended a list price of $215,based upon the comparable sales data [redacted] felt that her home was of greater value and wanted to list the home for $220, [redacted] also provided her with an estimated net proceeds sheet, which [redacted] signedOctober 10th, We received an offer on the home from [redacted] , who was a licensed real estate agent in Indiana and was personally buying the homeNegotiations occurred and after counter offers, [redacted] rejected the agreementOctober 11th, [redacted] submitted another offer for herself in the amount of $216,After counter #1, the offer was accepted by all parties for $216,October 16th, Buyers completed their home inspectionOctober 23rd, Buyers sent the Independent Inspection response and didn't ask for any repairsHowever, the inspection did reveal that there was no battery back up to the sump pump which had been noted on the Seller's Disclosure formBuyer stated that if seller didn't want to provide battery bato the sump pump that seller had disclosed, would they be willing to leave the two fans in the garage? This infuriated ***However, it is was our agent's duty to share this information with herOctober 29th, The appraisal was completed [redacted] requested that [redacted] solicit additional offersPer ***'s request, our agent left a message for another agent that had showed the property requesting that he show the home again and encourage a backup offer, if his clients had interestThis showing agent NEVER submitted an offer.October 3152, [redacted] contacted the office wanting to speak with the managerI spoke with ***She said she was not happy with the price she was getting and wanted us to waive our commissionShe made the decision to list her home for $220,and accepted a purchase price for $216,I told her we achieved getting her 98% of her list price, she accepted the terms in writing and we were not going to waive our commissionShe told me, If we didn't comply, she said she would file a complaintNovember 10th, [redacted] wanted the closing moved to 6:30pm and the final walk through to be 4pm or 6am the day of closing [redacted] , who took over the transaction at ***'s request for another agent, explained that title companies only work business hours [redacted] then agreed to the scheduled closing time of 4:30pmNovember 12th, Closing occurred on the home at the time that was scheduled and agreed to by all partiesPlease let me know if you need any supporting documentationSincerely, [redacted] Responsible Broker CENTURY Scheetz
