Review: In June 2008 we specified 24 of [redacted] Group’s “Belvedere” light fixtures to be installed in an exterior location at Klyde Warren Park, a public park in Dallas, Texas.

The intended use of the fixtures (that they were to be installed in an exterior location in a public park) was known by [redacted] since specification. It was discussed with them by phone during the specification phase and in writing during the submittal review process on 9/**/2011.

The light fixtures are not strong enough to hold up in the park. They deform and must be "banged out" by the owner and repainted, repeatedly.

We have told [redacted] of the problem on the phone and in writing (emails dated April **, 2013) and asked for their assistance. We received none. We made approximately 2 phone calls and sent 3 emails requesting help.

On April **, 2013 we asked the manufacturer [redacted] in writing to build a sample fixture out of stronger gauge metal to see if this would solve the problem.

[redacted] agreed by email on May **2013 and estimated a ship date of 10 days later. Since then we have sent approximately 15 emails, made 3 phone calls, and had 1 in person conversation with [redacted] requesting the corrected product. [redacted] continues to be non responsive or has given answers like "the factory is on vacation" or "the fixture is stuck in customs." This has been their response for 7 months.
