Initial Business Response /* (1000, 5, 2015/03/11) */
*** to C & C Investments of chicago
in the midst of our negotiations buyers attorney submitted a letter stating if we did not meet their demands that the contract be null and voidWe disagreed with their demands and choose to
terminate the contractThe earnest money should have been returned to the client as the Realtor was in possession of it
As far as items for reimbursement those are clearly stated in the standard real estate contract that they are at buyers expense/riskAll of the action we took to terminate the contract was well with in our rights as the seller
Initial Consumer Rebuttal /* (3000, 7, 2015/03/12) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The only correspondence from my attorney was asking that several deficiencies discovered during Home Inspection be correctedThese fixes could have been declined by seller and we would have still proceeded with the sale
As of today, March 12, 2015, I still have not received the earnest moneyThis is over a month after they terminated the sale
Final Business Response /* (4000, 11, 2015/03/27) */
The items stated that if we did not agree to his requests that we could cancel the contract which is the route we choseI have signed the release of earnest money and Mr*** should have received it by the time of this response
At the time of closing for our new home, March 22 2014, we had a punch list of items that needed to be fixed by the seller. It is now April8 2014 and there is still one item that has not been completed. It is not so much the inconvenience of having to deal with this issue it is more the way we are being treated by the seller. I have sent numerous emails that will go unanswered for days on end. Even the lawyer that I hired for the closing of the house cannot get a response from the seller. I am being forced to look for other legal counsel to try to urge the seller to finish what we all agreed upon. It seems that after we closed for the house the seller decided to just forget about our agreement and has moved onto their next sale. This is totally unprofessional and we are unsatisfied with the way we have been treated.
