Gave a $1,000 deposit on 8/15/19. On 10/14/19 I notified Bill B to cancel. $850 has been refunded to date with $150 still owing.
All of my communication has been with Bill B, owner. On 8/15/19 I gave a $1,000 deposit with my Debit card to secure Catering services for an outdoor wedding in our back yard. He gave me an invoice, I did not have to sign anything and there was no discussion of any portion of the $1,000 deposit being non-refundable. I emailed & called on Mon,10/14/19 to notify Bill that we had cancelled our wedding in our back yard and asked for the return of the $1,000 deposit. He said he needed until the end of the week, Fri 10/18 to come up with the money. On 10/18 I emailed him at 3:33 pm to see if he was able to issue the refund and I offered that if he couldn't refund the full amount that day, that I would be willing to accept a partial payment of $500 with the remaining $500 to be paid the following week. He sent an email back saying he would send out $500 on Monday 10/21 & then the balance the next week. On 10/14 I emailed him to see if he sent the check, he responded on 10/25 indicating it went out in that days mail. 11 days later I still had not received the 1st check and the date had already past for when he should have sent the 2nd check. I finally rec'd the $500 credit. Then on 11/13 emailed again as he had indicated he would send the 2nd $500 check out by mid-week, meaning 11/13. Once again he said he would give the $500 balance on Mon, 11/18. On 11/25 still no refund so I emailed him again. He responded he would send it out on Fri, 11/29. I expressed that I was broke and asked if he could send anything now. He credited $350 just after Thanksgiving. On 12/12 I emailed again asking about the last $150 pmt. He finally responded 3 days later on 12/15 and said he would send it out first thing in the morning. On 12/19 he sent me an email saying I should see the refund to my acct in a day or two. On 12/31 I still had not rec'd and at that point, I told him my bank acct had to be closed because of fraudulent activity and gave him my new bank acct info so he could issue the credit. On 1/11, 1/13, 1/16, 1/25, 1/30 I reached out to him again and each time was another broken promise. On 1/31 he sent an email saying the credit was issued to my acct that morning - like a broken record - never got the refund. On 2/3 he said the refund processed that day and should see the credit in two days - never happened. 2/15 & 2/16 sent another email. On Sat, 2/22 I told him I would drive to Manchester and pick up the check. He responded at 9:19 am Sunday 2/23 and said he would drive it out to me that morning. Never came. I left him two messages and still have not heard from him.
$150 payment by means of Cashier's check or bank check OR credit to my checking out # he has on file. He has never denied he owes me the money so I have not attached any documentation. However, I have all the emails and paperwork if needed.
