December 19, 2015, Mr. [redacted] opened a $750.00 Line of Credit with CashNetUSA. Mr. [redacted] signed his line of credit agreement stating he understood and accepted the terms and conditions associated with the line of credit. At all relevant times, our lending, fees and interest, and charges have complied with the applicable laws of Virginia. The fees and interest applicable to the advance Mr. [redacted] requested were fully set forth in the loan agreement, a copy of which was provided to him when he opened the account. On December 21, 2015, per Mr. [redacted] request, he was funded a $750.00 advance. Since then, he has made only minimum payments on his account. Mr. [redacted] always has the option to make additional payments or repay the amount outstanding in full at any time without penalty. As set forth in Mr. [redacted] line of credit agreement, he is required to make at least the minimum payment every billing period he carries a balance. The minimum amount due on each due date will be 15% of the outstanding balance and any fees plus all interest accrued. As set forth in Mr. [redacted] Line of Credit agreement, interest charges are assessed when the statement closes to the amount borrowed for that billing period. We do not charge interest on fees or accrued interest (no compounding). The daily periodic rate applied to his account is 0.8192%. The corresponding Annual Percentage Rate is 299%. In addition to interest, there is also a transaction fee. As set forth in Mr. [redacted], Line of Credit Agreement, there is a transaction fee for every advance requested; the transaction fee is 15% of the total amount borrowed. In addition to disclosing the charging structure from the outset, we keep our customers informed by supplying periodic statements. Amongst other loan details, the due date, minimum payment amount, and account balance are shown on each periodic statement. CashNetUSA values Mr. [redacted] as a customer and strives to provide the ultimate customer experience. Subsequently, Mr. [redacted] requested to rescind his loan.
On June 30, 2015, CashNetUSA honored his request to rescind his loan via email; as such Mr. [redacted] authorized a debit for the principal payment.
On July 3, 2015, the principal amount of $500.00 was successfully collected from Mr. [redacted]'s account.
At this time Mr. [redacted] does not have a balance with CashNetUSA.

Conditions associated with the loan, including the Loan Duration, Annual Percentage Rate, Finance Charge, Amount Financed, Total of Payments and the Payment Schedule. Mr. [redacted] then signed his loan agreement stating that he agreed and accepted the terms and conditions associated with the installment loan. Further, Mr. [redacted] agreed to an Automated Clearing House (ACH) authorization. On January 2, 2015, Mr. [redacted] account balance went into delinquent status. As such, our collection efforts were initiated. However, it is always our prioritized goal to adhere to and comply with all regulatory requirements while conducting regular and collection business. We train our staff accordingly and follow the collection guidelines set forth by the Fair Debt Collection Practices Act (FDCPA). After remaining in a delinquency status for over 360 days, CashNetUSA sold the account to a third party debt buyer, National Credit Adjusters (NCA), on May 27, 2016. Inquiries regarding this debt should be directed to NCA - their direct contact number is 800-286-5427. CashNetUSA has not attempted to contact Mr. [redacted] or collect on his account since we sold the account to NCA on May 27, 2016. CashNetUSA is sorry to hear Mr. [redacted] was not happy with the services he was provided, however, CashNetUSA is licensed to provide financial services to residents of South Carolina. Our records indicate that Ms. [redacted] has applied for financial services with CashNetUSA several times through third party marketing partners; however, CashNetUSA was not able to approve her application. Therefore, CashNetUSA has never issued a loan to Ms. [redacted].
CashNetUSA has not attempted to contact Ms. [redacted]. Based on the complaint details it is clear Ms. [redacted] has been contacted by fraudulent collectors. CashNetUSA has no knowledge of or control over the conduct of the individuals who contacted Ms. [redacted] who are posing as a collection agency or law firm. Therefore, and unfortunately, CashNetUSA cannot prevent them from calling Ms. [redacted].
Ms. [redacted] requested her information be deleted from our database; please note her CashNetUSA account has been deactivated. She will not receive further correspondence from CashNetUSA and will no longer be able to log into her customer profile. However, CashNetUSA will not be able to honor Ms. [redacted]'s request to delete her personal details from our internal database. State and Federal laws require CashNetUSA to retain a record of customer information submitted to us as part of an application for set periods of time.

On May 5, 2016, Mr. [redacted] was funded a $500.00 Payday loan with CashNetUSA. He signed his agreement stating he understood and accepted the terms...
and conditions associated with the Payday loan. Further, Mr. [redacted] signed an Automated Clearing House (ACH) authorization allowing debits and credits to be made with his bank account. On May 18, 2016, the full balance of $549.09 was due. Unfortunately, Mr. [redacted] did not make this payment. We received notification from Mr. [redacted] financial institution that the payment returned because the available balance was not sufficient to cover the payment. Therefore, a $25.00 NSF fee was assessed to Mr. [redacted] account balance. All collection attempts made to Mr. [redacted] bank account were authorized by him. He signed his loan agreement stating he agreed to the ECHECK/ACH AUTHORIZATION. Per his loan agreement which states in relevant part: ''If the initial ECheck/ACH debit entry is returned unpaid or dishonored for any reason after we first present it for payment, you agree that we may re-present the initial debit entry for payment by re-presenting the total amount that remains due (not including any applicable NSF charge described below). If all or any portion of the first re-presentment is returned or dishonored, you agree that we may again re-present the total amount that remains due (not including any applicable NSF charge described below). '' Contrary to Mr. [redacted] assertion, CashNetUSA has not assessed three (3) ACH charges to his account. We will only charge one NSF to his account balance; however his financial institution may charge additional fees. Per his agreement which states in relevant part: “You will only owe us one $25.00 NSF fee if the initial ECheck/ACH debit entry for the Total of Payments on the Maturity Date is returned unpaid or dishonored because of insufficient available or uncollected funds, regardless of whether we attempt one or two representments of that initial ECheck/ACH debit entry. However, your bank may charge you fees for each individual ACH debit entry we submit that is returned unpaid or dishonored for any reason, if and to the extent such fees are allowed under the agreement between you and your bank concerning Your Bank Account.” Based on the findings of our review, we found no breach in our process that would justify refunding Mr. [redacted] account. Based on the description of the complaint, it appears that she is being contacted by a fake entity impersonating CashNetUSA. We have been made aware of fake entities using our trade name in an attempt to extort money from consumers who may or may not have ever obtained a loan from us. While we sympathize with Ms. [redacted]’s situation, we cannot take action because the complaint is not related to CashNetUSA. In addition, the fees and interest applicable to a cash advance were fully set forth in the loan agreement, a copy of which was provided to her (via email) when she opened the account. Further, Ms. [redacted] signed an Automated Clearing House (ACH) authorization permitting CashNetUSA to automatically withdraw payments from her nominated bank account. Over the course of her relationship with CashNetUSA, she has requested numerous advances and paid the minimum amount on her account balance each billing period. However, after being in a delinquency status for over 90 days, on March 27, 2015, CashNetUSA sold the account to a third party debt buyer, [redacted] The direct contact number to [redacted] is XXX-XXX-XXXX.
On May 19, 2015, Ms. [redacted] contacted us and asserted that she was the victim of identity theft. As such, CashNetUSA advised Ms. [redacted] to please submit a police report to our fraud department to investigate her claim.

using her personal information. On March 15, 2016, Ms. [redacted] reported that she did not apply for the loan. CashNetUSA advised Ms. [redacted] that in order for CashNetUSA to investigate her claim, it would need a copy of a police report or fraud affidavit. On August 12, 2016, CashNetUSA received Ms. [redacted]’s police report. After a careful investigation, and a confirmation by Ms. [redacted], it was determined the deposit of $200.00 was credited to her bank account ending in [redacted]4423 - with [redacted] NA - on March 15, 2016. Therefore, it is our position that Ms. [redacted] still benefited from the money that was deposited to her bank account. Based on our findings we are not able to accept Ms. [redacted]’s claim of fraud. We hope that this response resolves this complaint and answers any questions that your office has. on January 22, 2018. What this means is that Mr. [redacted] input his information into another website that then linked him up with CashNetUSA as a potential loan provider. However, based on the information provided on the application, we could not approve the request for a loan. Since Mr. [redacted] is asserting that he did not submit an application for credit, we ask that he please file a police report with his local authority and submit a copy of the police report to CashNetUSA so that we can launch an investigation.
