I purchased a car from *** at Car Boss. I gave her $4028 for a down payment. I was financed through ***. She cancelled my financing and will not return my down payment. She is now telling me that I need to get my own financing after she cancelled my financing. And she has the car. I do not have the car. So she has the car and my money.
Car Boss Response

purchased a 2008 Lincoln MKX on May 21st. I got her financed through *** with $4028 down. The down payment is high because her credit score is 505.
The Lincoln had an airbag recall due and I asked her if she would like me to get it done or would she do it. She said she would do it. 5 days after purchase *** took the vehicle to Ford to have the recall remedied. Later that day Ford calls her and tells her the engine was damaged during their 8 mile test drive and would require a new engine. She called me very upset and I had her put the Ford manager on the phone. I said “This vehicle was running perfectly when she brought it in and now it needs a new engine, that sounds very fishy to me” the manager was very misinformed and thought Ms.Lee brought it in for a stalling issue, not an air bag recall. Ford told *** they would fix it. They gave her a loaner to drive while they fixed it.
Almost a month later, Ford informs *** that they will not fix the vehicle. *** immediately calls *** and files a breach of contract complaint, stating the vehicle was defective requesting the loan be nullified.(I do not discover this until July 7) *** calls me very upset and tells me Ford won’t fix it. I explain sometimes those responsible don’t take responsibility and we just have to pay the piper, even though none of it is our fault. I tell her I will pay for half the cost of the motor replacement. Total $2500 so that is $1250 a piece. She agrees and is thankful, I pay to have the Lincoln towed ($155), give her a loaner car to drive for the 3 weeks of repair. *** bought an AS-IS vehicle and denied the purchase of a warranty offered her. Legally, I did not have to help her at all.
On July 7, I received the attached demand letter from *** demanding a repurchase of this vehicle to cancel the loan. I pay it, so now the vehicle belongs to me. I told *** we will have to work out financing for the remainder $4198 plus $1200 for engine repair. When the Lincoln was ready I contacted *** and told her I would try to get her approved through Lobel because I was unable to finance it personally, as I had hoped I would be able, due to Covid re-surging. *** had no money to help pay for her part of the engine. Lobel turned her down because of her very poor credit. I told *** she would have to find her own financing, I would give her a week to find $4198. Now *** is irate, yelling, calling me a scammer and a liar, and I hung up on her. I’m guessing this is when she filed this complaint with you, the Revdex.com. I let her cool down a day and explained that if she stopped to do the math, she would see that the $4198 did not include the cost of the engine. I would cover that expense entirely. Now it seems she has had a change of heart and realizes this is the best option. Her downpayment is non-refundable, I am doing my best to get her into her vehicle, which has proven to be at great cost and stress to me.
She says she will have the money within 10 days. I told her I was glad to hear it and her vehicle will be waiting for her. She allows emotions to dictate her decision process. I can’t guarantee she won’t revisit this case, in the near future, if things don’t go her way over the next several weeks. *** told me she has called the Revdex.com to have this complaint retracted, but I feel better having my testimony on file.
Thank you,
