June 2, 2015Dear [redacted] ,In response to your initial complaint by [redacted] ***, the response of my client is as follows: They have been in business for approximately years at this location and have contact with between and individual customers per day The pawn shop is open days a week My client only received your first letter which was dated May 26, 2015, and therefore was unable to respond to your letter prior to this time There was a question Concerning the various dates on receipts and the dates are determined by Computer and they update every daysTherefore, the dates would not stay Consistent due to the number of days varying in each month, i.e., if a payment was received on May 1st, the next payment would be due May 31st, not June 1stThis is required by state law and regulations, My client spoke with his employee Brandon and due to the traffic and volume of business in the store and the fact that employees were located in different stores, if a phone conversation was held for minutes that would have been extraordinarily long and under no circumstances there would have been a phone call lasting for one and a half hours It is also denied that [redacted] was told by anyone at the store that "the jewelry was no longer there because an employee allegedly stole the jewelry and/or that an employee was fired because of the theft of [redacted] ***'s jewelry." It is also denied that neither Brandor nor anyone else at the store offered to replace [redacted] ***'s jewelry with any other jewelry in the storeIf in fact [redacted] ***'s jewelry had been lost, stolen and/or misplaced it is the store's policy to offer to pay for the jewelry and not to attempt to replace the jewelry due to its unique nature and the fact that the store is not a manufacturer of jewelryIn addition, because the jewelry is used, it would be virtually impossible for the store to duplicate the jewelryI cannot comment on [redacted] ***' believes as to how long the jewelry had been missing, because this is pure speculation on her part In addition, the jewelry was secured and as a result it is the store's policy not to show it to a customer because the customer simply because the customer was paying the pawn charges, Nick denies that he told anyone that he had the authority to do as he pleased with the customer's property, because the pawn and distribution/sale of the jewelry is governed by state law and regulationsAdditionally, there were comments about the fees and the change in the amount of fees on the pawn receipt, Admittedly there were changes from $to $because of a computer problem and it was clearly noted on the pawn receipt As to the allegation that there were verbal agreements between anyone at Capital Cash and [redacted] for any reason, this is denied because it is the store's policy as well as the laws and regulations of Pennsylvania that all transactions must be in writing and not the result of verbal agreementsFor your information, attached is a request by my client for a copy of the police report relating to the incidentPlease note [redacted] was informed by the Muhlenberg Township Police that no criminal report has been prepared at this time and that they will prepare the report and I will supplement my response to you.Your Courtesy and cooperation in this matter are appreciated,I regret the delay in responding to your inquiry; however, as noted above, your request was onlyreceived following your May 26th letter and not prior to that time.Sincerely,

From: [redacted]<[redacted]@[redacted].com>Date: Thu, Jun 18, 2015 at 12:16 PMSubject: Rebuttal #[redacted]To: [redacted] <[redacted]@myRevdex.com.org>Here is the receipt that was given to me by Brandon on 12/19/14 the day I went to pick up my jewelry. He couldn't even find me in the system at all when I went on 12/19/14. He told me that this is what popped up when he put my name in the system! If you look really close you will see where it says bull.... scratched out that Brandon scratched out himself! I was with [redacted] on that day 12/19/14 who will attest to this! I also have another witness Who will attest to the finance charge of $125 the last four months while my pawn was there and he also was one of the people that would go and pay my pawn fee when I couldn't his name is [redacted]!
June 2, 2015Dear [redacted],In response to your initial complaint by [redacted], the response of my client is as follows:1. They have been in business for approximately 5 years at this location and have contact with between 100 and 250 individual customers per day....
The pawn shop is open 6 days a week.2. My client only received your first letter which was dated May 26, 2015, and therefore was unable to respond to your letter prior to this time.
3. There was a question Concerning the various dates on receipts and the dates are determined by Computer and they update every 30 days. Therefore, the dates would not stay Consistent due to the number of days varying in each month, i.e., if a payment was received on May 1st, the next payment would be due May 31st, not June 1st. This is required by state law and regulations,
4. My client spoke with his employee Brandon and due to the traffic and volume of business in the store and the fact that employees were located in different stores, if a phone conversation was held for 10 minutes that would have been extraordinarily long and under no circumstances there would have been a phone call lasting for one and a half hours.
5. It is also denied that [redacted] was told by anyone at the store that "the jewelry was no longer there because an employee allegedly stole the jewelry and/or that an employee was fired because of the theft of [redacted]'s jewelry."
6. It is also denied that neither Brandor nor anyone else at the store offered to replace [redacted]'s jewelry with any other jewelry in the store. If in fact [redacted]'s jewelry had been lost, stolen and/or misplaced it is the store's policy to offer to pay for the jewelry and not to attempt to replace the jewelry due to its unique nature and the fact that the store is not a manufacturer of jewelry.
In addition, because the jewelry is used, it would be virtually impossible for the store to duplicate the
jewelry.7. I cannot comment on [redacted]' believes as to how long the jewelry had been missing, because this is pure speculation on her part.
8. In addition, the jewelry was secured and as a result it is the store's policy not to show it to a customer because the customer simply because the customer was paying the pawn charges,
9. Nick denies that he told anyone that he had the authority to do as he pleased with the customer's property, because the pawn and distribution/sale of the jewelry is governed by state law and regulations.
10. Additionally, there were comments about the fees and the change in the amount of fees on the pawn receipt, Admittedly there were changes from $45.74 to $25.50 because of a computer problem and it was clearly noted on the pawn receipt.
11. As to the allegation that there were verbal agreements between anyone at Capital Cash and [redacted] for any reason, this is denied because it is the store's policy as well as the laws and regulations of Pennsylvania that all transactions must be in writing and not the result of verbal
agreements.
12. For your information, attached is a request by my client for a copy of the police report relating to the incident. Please note [redacted] was informed by the Muhlenberg Township Police that no criminal report has been prepared at this time and that they will prepare the report and I will supplement my response to you.Your Courtesy and cooperation in this matter are appreciated,I regret the delay in responding to your inquiry; however, as noted above, your request was onlyreceived following your May 26th letter and not prior to that time.Sincerely,
