Dear Kaina, the $was just for the cake Yes, the part on the contract for delivery of services was not filled out, and we were unaware that the customer could modify that part of the contract, so didn't think to check that part....Also there was never mention of a delivery asked for, or a quote for a delivery, and in the initial inquiry she said she did not want delivery. Here is our correspondance
Complaint: [redacted] I am rejecting this response because:When given the contract, I was asked to fill in the highlighted areas, which included the delivery information Through this whole process I have not actually spoken to a person I would think that entering in the information they had requested qualifies as informing them And to clarify, I did not alter the contract I simply filled in the highlighted areas as requested I don?t think it was possible to alter the contract Sincerely, [redacted] ***
I recently worked with Cake Works to create a cake for my son's birthdayI filled out an inquiry online to see if they were available and to get a quoteThey communicated with me through [redacted] We went back and forth until details were setEverything was later finalized with a contract signed by the vendor and I and by paying in fullOn the day of my son's party, I waited for the cake to be deliveredAfter minutes, I decide to callTo my surprise, I was told my cake was not arranged for deliveryI checked my contract several times and it indeed included delivery date, time, and locationThere was no way I was going to be able to leave the party and drive into town to pick up the cake in timeThe person I spoke with informed me that the only way they would deliver was if I paid an additional fee outside of what was contractedI explained to her that it was already included in my contractI had no choice but to pay the additional fee and the person told me I could call
Customer was not quoted for delivery and never said she wanted delivery in any of the correspondence that we had with her She added a location for delivery in the contract, but failed to request one, therefore we did not know anything about said delivery, and it was not included in her quote
Had the customer at any time asked for a delivery we would have quoted her for a delivery and added it to her list of servicesIt is our fault that the customer was able to add that into the contract, to be sure, but she never told us she wanted a delivery When she called we informed her we could deliver the cake but it would be an additional $which she then paidOn our website and elsewhere it is stated that deliveries are between $and $depending on location I would be happy to share the delivery with the customer, for the misunderstanding involved, but customers have to understand that getting the correct goods and services are the responsibility of both parties
