My semi truck was towed away by this company to their shop/holding spot this was on a Friday On Friday night when I went to check my truck I found out that truck was not there. I called my company and asked them to track my trucks gps and they gave me this company's address. I called them up Saturday morning and they said they said they were closed and that confused me a bit. I decided to go there and check my truck and when I arrived there I asked employee if they were closed in which he responded "No" but that the lady from the office had just left and wouldn't be back till Monday. Now, I called her at 9 am and I arrived there at around there at around 1-2 pm and she had just left around 5 min before I got there which made me realize that they wanted to get for storage of my truck. So, when I get there on Saturday to check my truck, I see my truck with hood open and someone working on my truck. I asked the guy who was working on my truck that what was he doing under my truck and he said that he was just cleaning it from underneath. Now, my truck was towed for being parked where it shouldn't. It was not there for any repairs. I went there Monday and nobody knew anything nobody wanted to tell me anything. Finally I was told to walk into owners office and he said he knew nothing and could do nothing. Finally after arguing with owner a while he said he would call driver who picked up my truck and same thing, he said he knew nothing and then he confesses after I tell him that I came here on Saturday and took pictures and video of them working on my truck. He said he just replaced a small hose he broke when attaching his hose to my truck but when I check my truck I notice that in engine compartment I see hand prints on opposite side of hose he mentioned but did think anything of it then. So I call my company a week after and start on my way to San Antonio and when I Check my truck I see an oil spot on floor which it never had an oil leak and thought fix it later then start to loseing air pressure.
THANK YOU FOR THE OPPORTUNITY TO RESPOND TO THIS DISPUTE BECAUSE I FEEL THAT I AM BEING WRONGFULLY ACCUSED OF NEGLIGENCE. I AM PROVIDING A SUMMARY OF WHAT TRANSPIRED IN THIS CASE ON OUR PART.
ON APRIL 3RD, 2020 WE WERE CALLED BY MANAGEMENT OF *** TO PICK-UP AN ABANDONED FREIGHTLINER TRACTOR. OUR TOW DRIVER WAS INFORMED THAT THE TRACTOR HAD BEEN THERE ABANDONED FOR ABOUT A MONTH AND THAT IT NEEDED TO BE REMOVED FROM THE PREMISES. OUR DRIVER PREPPED THE TRACTOR AND TOWED IT TO OUR STORAGE YARD/ ***. THE TRACTOR INFORMATION WAS REPORTED TO *** POLICE DEPARTMENT AS A PRIVATE PROPERTY TOW.
AFTER THE TRACTOR WAS TOWED TO THE YARD THE DRIVER NOTICED THAT THE ELBOW FITTING WAS LEAKING AIR. HE ASSUMED THAT HE CAUSED THE DAMAGE AND DECIDED TO FIND A MECHANIC TO FIX IT. THIS WAS DONE IN GOOD FAITH AND THE DRIVER ASSUMING HE CAUSED IT. IT COULD BE THAT IT WAS ALREADY DAMAGED AND THAT IS WHY HE ABANDONED THE TRACTOR IN THE FIRST PLACE. THERE MAY BE OTHER REASONS/MECHANICAL AS TO WHY IT WAS PARKED THERE.
THE DRIVER SPOKE TO *** WHEN HE CAME TO PICK UP THE TRACTOR. HE TOLD HIM ABOUT THE REPAIR THAT WAS DONE AND THAT HE COULD INSPECT IT BEFORE TAKING IT OUT. *** ALONG WITH OUR DRIVER INSPECTED THE REPAIR DONE AND CAREFULLY CHECKED IT EVERYTHING ELSE AND AGREED THAT IT ALL LOOKED GOOD AND AGREED TO PAY THE TOW CHARGES. STORAGE CHARGES WERE WAIVED. AN INVOICE WAS PROVIDED TO *** AND IT REFLECTS TOW CHARGES WITHOUT STORAGE. IF HE FELT THAT THERE WERE OTHER DAMAGES THEN HE SHOULD NOT HAVE TAKEN OUT THE TRACTOR. MAYBE THE ADDED MALFUNCTIONS OCCURRED IN THE WEEKS THAT HE WAS DRIVING AROUND. BOTTOM LINE IS THAT HE CHECKED IT OUT BEFORE REMOVING IT FROM OUR PREMISES. I WILL NOT TAKE RESPONSIBLILITY FOR OTHER DEFECTS HE FOUND AFTER TAKING TRACTOR AND THEN DECIDING A WEEK LATER THAT WE CAUSED THEM. THE DAMAGES THAT HE IS CLAIMING COULD HAVE OCCURRED BECAUSE OF THE TOW OR CAUSED BY THE TOW TRUCK. HE IS ALSO CLAIMING $600 A DAY AS DOWN TIME WHICH TO ME SOUNDS EXCESSIVE FOR A DAY'S WORK BUT THAT I WILL ALSO NOT TAKE RESPONSIBILITY FOR.
IT BEARS REPEATING THAT THE TRACTOR HAD BEEN ABANDONED FOR ABOUT A MONTH WITH NO MAINTENANCE GIVEN TO IT. THAT CAN'T BE A GOOD SIGN.
