C & R Auto Sales

A down payment was made on a 2007 black *** which is the vehicle in question. Only due to the fact that the original vehicle that I looked at was gone once I got there. Chris the owner of C and R auto continue to tell me that he found a better vehicle for me and he sold the one that I picked out. He continued to tell me all the extra perks that this vehicle had yes the down payment was made he put dealer plates on the car and I drove off. About a week later there was a high idle that wouldn’t go away when you started the car if you came to a stop for too long the car would go into a high idle as well as if you hit a bump the trunk will pop open continuously. I called Chris told him about the issues he told me to bring it back to him So the issue could be fixed, nothing ever was resolved. Doing my own investigation I found that he only bet the latch to the truck which I drove around with for the time I had the car. The car was brought in to be maintenance I was told that the issue was in high idle due to possible throttle acceleration issue. It was fixed it only was resolved for about 2 1/2 to 3 weeks and then it started over. Now November 2019 Rolls around and insurance has to be renewed. Instead of renewing it a decision was made to switch insurance companies. In which it was brought to my attention that the car had already been totaled out and had a salvage title which was not disclosed to me by Chris when He told me that he had a better vehicle for me. Within the time of me finding out that the vehicle had a salvage title and what I could do with the vehicle and regards to possibly returning it to him to receive payment or wiping the slate clean I got into an accident. Now that the accident occurred the insurance company quoted the damage wrote the check to him for what was left on the car and that was that. My question is is it legally right for him to sell me a vehicle that has a salvage title without letting me know that the vehicle has a salvage title. I also have information that the title was salvage in car was totaled out due to an accident. Chris purchased a vehicle from an insurance auction and watch him being a mechanic fixed it and sold it which is not a problem for me the problem is that he sold me a salvage vehicle without me knowing which caused continuous repair that I did not want him to continue due to the fact that things that he claimed he fix in the beginning were never fixed. And quite frankly I feel that he never touched it he just let the car sit there and told me that he fix the vehicle. Chris purchased a vehicle from an insurance auction and watch him being a mechanic fixed it and sold it which is not a problem for me the problem is that he sold me a salvage vehicle without me knowing which caused continuous repair that I did not want him to continue due to the fact that things that he claimed he fix in the beginning were never fixed. I caught a question about the lock he informed me that he was waiting for the lock to come in when it came in he will repair it and call me back the lock was never replaced he just bent the latch.. Question number two would be is it legal also for him to be able to finance a vehicle with a salvage title that he did not let me know about. So as I’m trying to fix it and take care of the issue as well as not pay him finance charges are accumulating on a vehicle that should not have even been sold to me. So if there is any other information that I might need to gather if a case is beneficial for me I would like to proceed.
