Review: We recently purchased a year end close out HOT Tub from Browning Pool. Before making a final decision, comparing comprable pools we went back to Browning to see if they would match the price of their 2013 closeout to two other vendors that we were comparing them with. We explained that we currently had a Coleman Hottub that was too expensive to repair based on age and that the Max, they were offering was comparable to what we currently have due to the steel framing and that Max use to manufacture the Coleman Tub. Their representative agreed to not match but come close to the pricing, so we signed a contract after visiting their showroom and working out several details. [redacted] who is the salesman tried initially to get us to sign a contract immediately, however I refused until I checked out a financing. At the time we were in the showroom there were a few items that we brought to [redacted]'s attention, Scuff marks on the cabinet and the apparent dirty state of the Hot Tub. [redacted] agreed to these terms and we signed the contract on what were were told was a 2013 closeout. Upon delivery and under natural lighting we notices a completely different color (silver) in the corners in several locations of the Hot Tub. The guy who delivered and installed the Hot Tub agreed that this was not right and we should notify Browning and ([redacted]). When we notified [redacted] he immediately became defensive and said to send him pictures. I, at that time insisted that he come to our home to look at what we were talking about. He refused and said that's the was they were made. Not happy with his negative response to customer service, I drove to the local Browning Store, to speak with **. [redacted] Browning, because [redacted] had told me that that's where I could find him. When I got there **. Browning had left for the day. The young lady at the desk then put me in touch with Customer Services, who after explaining our situation, helpfully scheduled for a tech to come out the next morning. When the tech arrived on November 1, 2013 they immediately called **. Browning and told him that he needed to come look at our situation, that this was not right. **. Browning came out and again told the tech that this is the way the tub is suppose to look. Note: we have a blue tub, and the corners are silver, indicating that some repair may have been done on this tub, prior to selling. To me, this is now a used Hot Tub, not a 2013 closeout. Not sure how others may look at this but to me this seem like fraud or deceipt. **. Browning then told my wife that he had spoken to the MAX representative who had concurred that this is the way the tub should look and added that what do you expect this is a 2011 model. This then infuriated both my wife and me. My wife asked for the phone number to the manufacturer and after some reluctance **. Browning gave her the number and a person to contact, and said this is a take it or leave it deal. My wife said that the tub as it is , is not acceptable, however we want to contact the manufacturer directly before making a decision. Shortly after **. Browning agreed to give us time to check it out, [redacted] called and said they were coming to pick up the Hot Tub. At that point I told him to listen to me, I was tired of his lying to me, one lie after another, and explained that **. Browning had agreed to let us look into the problem further. He said they were coming to take the Hot Tub. At that point I explained that if he set foot on my property, I would have him arrested. Shortly after that confrontation my wife called the Max Customer Serives dept. and explained th situation. They immediately responded that there should not be any color distortion at all, especially to the degree we were describing. Again Browning Pools was lying to try to maintain a strong arm sales approach. MAX also confirmed by the serial number that this is in fact a 2011 Hot Tub, not a 2013 closeout. We are in the process of sending pictures to MAX. Very dissatisfied over putting trust in our local businesses, fro a consumer point of view.Desired Settlement: Replacement of the existing Hot Tub with a 2013 or newer, as promised on original sale and now to the original color that we were trying to get, now that accoring to Browning Pool are no longer available in the 2013 models, and an apology letter from **. Browning for his brash, take it or leave it approach to business and customers.

Response:

To whom it may concern,

This is in reference to ID [redacted].1 apologize for any issues the [redacted] have had with the spa they purchased. It was part of our end of the year spa clearance sale. Regardless of when the spa was manufactured it is a brand new spa. It carries all its original warranties that begin once the spa is purchased.

Browning Pools did send pictures of the spa to MAAX at the [redacted] request. MAAX did confirm that this is a normal occurrence that can occur when bending acrylic. However, Browning Pools and Spas is more then willing to pickup the spa and refund the [redacted] money in full. I personally offered to do this the day after the spa was delivered.

Again, I apologize to **. And [redacted]. [redacted] and would like to pick up the spa and refund their money so that they can move forward with a company they feel they can trust.

Sincerely
